To all concerned,

Today I received a collection notice from you and had to laugh. You are the most stupid bunch of morons and thieves I have ever encountered. Just how stupid do you really think I am?

Your collection notice in itself is a direct violation of the FDCPA. This is due to the fact that you are knowingly attempting to collect a time barred debt, even if I did still owe it, which I do not. The last activity on this debt was 1986. That is almost 20 years!

FYIThe SOL in NY [where the debt was originated] is 6 years. The SOL in FL, where I currently reside is 5 years. What part of SOL [Statute of Limitations] do you not understand? This violation in itself is worth $1000 + court costs as a minimum, and will be persued as I really need the money. You see, I am an 86 year old woman living only on SS below the poverty level and own nothing. So there is nothing for you greedy morons to get even if you could collect.

The FTC complaint has already been filed, and the complaints to the ACA and the AG are going out tomorrow. You will pay for this legal violation, as I have nothing better to do. Your reputation is of the worst in the industry. You might want to see: www.ripoffreport.com. You scumbags are famous.

This is a communication from a consumer who's legal rights were violated by a bottom feeding scumbag debt collector. Any information obtained will be used to fry your *** court.

F**k off and die.

Florence Smolarek.

Ps. I guess even morons like you can figure out that this is a dispute of debt. If you wish to follow through with this, please provide a copy of the contract I signed and an account history. You will need this in court if you feel you actually want to waste more of your time & money.

John,

Thanks for the "advice" but may I suggest that you look at the date of a post before posting to it or offering advice.

And, FYI...I wasn't looking for advice, I was just exposing a scam.

I know how to handle these lowlife, and it was done 3 years ago.

I get paid everytime!

No need to waste time with FTC and AG complaints. Technically, a debt collector can come after you forever for defaulted debt...however, once the statute of limitations is up...they've lost the power to successfully take legal action. Per the Fair Debt Collection Practices Act, you can send them a "cease communications" letter and that will be all that you need to do. Per this law they must cease collection activity.

Send the collection agency a letter via Certified Mail + Return Receipt (NOT regular mail) stating:

Per the Fair Debt Collection Practices Act, cease all communications with me about this alleged debt. This letter has been mailed via Certified Mail with Return Receipt. Receipt of this letter is being officially time stamped.
