merchants credit guide send me a settlement letter for 47.13 for an account i supposingly owe 94.25. So me like a dumby send in a check march 8th for this amount and requested a reciept. check has not cashed and no reciept nothing.

i get a letter in march from assetcare saying i owe 94.25 which happens to be the same account number as merchants. on the back of the letter from assetcare i seen that its for appl account from a house i lived at in 1999 apparently it must of been a final bill i never took care of its now 2007 almost 8 years later . they can not collect on this right? whats the staute of limitaions in pennsylvania to collect a debit? what can i do who can i call or make a complaint to ?

what about the check thats out there for 47.13 that is not cashed yet since last month? if i do a stop payment then i am charged $30.00 should i send these companies a letter telling them i do not have to pay this bedt its to old and not to cash the check? how should i handle this please anyone help?

also what about a company who has had something on your report that should not of ever been there as it was never a unpaid debt. i have the proof of the check front and back shows it was paid the same day the check was written? what are my rights with this?

and same company nco also has an account that does not or never exsisted on my credit report for about 4 years there own reps told me its not a valid account? i have contacted them and sent the proof as well to the 3 credit agencies nco has not gotten back to me?

Stephanie,

Anytime you make a payment on an old debt, you are affirming it and reset the SOL at the same time.

Please understand that it is NOT illegal to ATTEMPT to collect a debt that is past SOL, although it should be.

Now that you have made a payment, they can sue you for whatever they can document as the outstanding debt.

In the future ALWAYS ignore ALL collection letters and phone calls. The only thing you never ignore is the summons.

The reason the debt is listed twice on your credit report is that these are both junk debt buyers, and these debts get sold more frequently as they age.

Sending a letter to the other one may also cause some more problems for you. And, you are now tagged as an easy mark, so this debt will keep getting resold. Thats the way the bottomfeeder world works.

thanks steve i didnt no anything til i found this sight yesterday.. they both can not collect the debt right? only one can? beside that the check i sent them was for the 47.13 they can not take anything more i did not sign or authorize anything but the 47.13. i sent them each a letter today stating that they can not both collect it and that it was already sent in a payment in march and never cashed and also the statue of limitations is up on this. i must of mis understood the comments on here because i though they could not collect a debt on an old bill from 1999 and 2 different collects can not go after the same money? i must of misread i thought i read it was illegal for them both to try to collect this debt and that they can not because sol was up. i was not aware that even though i sent a payment before i knew the statue of limtations was up on this it restarted the sol. Now what do i do just since i faxed over those letters today?

Stephanie,

You reset the SOL and affirmed the debt when you sent payment. You violated all of the basic rules of dealing with debt collectors.

DO NOT stop payment on the check. But keep in mind, by sending them that check, you gave them all of your banking information.

Stay off the phone. NEVER speak to any debt collector on the phone.

Just let it go for now. Nobody sues for less than $100! Not even these freaks at Merchant's.
