I have experienced blatant discrimination trying to get Mercury Insurance to pay for my damaged car correctly. Lisa Openshaw has been contacting me telling me she will Total the car, I have received emails of her giving me estimates, and then she calls to say she will not total the car because I called her out on discrimination and bias. 

 

California Department of Insurance stated in writing that they found unfair claims practices. CADOI also states Mercury never submitted a subrogation demand to State Farm Insurance Tunisa Douglas. This is why proper payments were not recorded at State Farm. 

 

I am forwarding a separate complaint on State Farm Tunisa Douglas for the car damages claim. Inaccurate information is being reported , and my attorney is not handling any car damage matters. 

 

State Farm has recorded a check for $ 2,683.60 cashed. This check was never cashed. The facts are that Mercury Insurance responded to a CA DOI complaint I recently filed on them. In this letter they requested that I choose the auto body repair facility I wish to use for the damages to abide by my auto body rights. Nancy Oda cited unfair claims practices on this letter.  I chose Network Auto Body of Valencia estimate at $5,703.07 (damages seen only on the outside of the vehicle). 

 

A supplemental estimate was completed by Mercury Insurance for $ 2,960.10. These damages are for damages behind the bumper. The total of damages is $ 8,663.17. 

 

Mercury Insurance Lisa Openshaw sent me an email twice addressed to me and an attorney stating the value of thye vehicle is $8,500, then $9,500. To be totalled , the threshold has to be met at 75-80%. The threshold has been met and the car must be totaled. I since received an email from Lisa Openshaw to hire an appraiser to complete condition 2 of their policy to total the car. 

 

Only two checks were received from Mercury Insurance thus far for this April 2, 2015 car accident. They are $ 2466.53 and $ 2960.10. State Farm is supposed to reimburse Mercury Insurance for these two checks at $ 5,426.63. 

 

In addition, State Farm is supposed to abide by my auto body repair rights, however CADOI is stating State Farm is not under authority to total the car when their insured hit my car rear ended.  (see attached). In addition, I request that State Farm give authorization to total the car without having to request me to hire an appraiser and pay $500. The value according to Mercury that I accept is $ 9,500 plus tax. My appraiser doesnt understand why I need an appraiser when I agree with the $9,500 plus tax. 

 

Due to my conversation with Lisa Openhaw, totaling the car is a separate matter with no repair monies to be deducted. 

 

This is my complaint.
