Plaintiff brings this action against Defendant pursuant to the Americans with Disabilities Act, 42 U SC § 12101 et seq., as amended alleging unlawful discrimination based upon a disability, and unpaid wages and termination in violation of public policy, within the 6 months prior to filing a charge at the national labor relations board, the above named employer and officers threatened to discipline employees and terminated employee Jerome C Sills because, employees engaged, in protected concerted activity and expressed an intent to file board charges in violations of section 8(a)(1), and (4) of the act. Methods machine tool proposed unacceptable settlement agreements in writing that could not be approved by the NLRB, because of the way the language was written, the charge / case number 01-CA-334849. An appeal was taken to the General Counsel of the National Labor Relations Board from the action of the regional director and refusing to issue a complaint on the charge, this would seem inappropriate because settlement negotiations were in process at that time. The EEOC/also issued a charge number 523-2024-01385 in violation of title VII of the Civil Rights Act of 1964, as amended: and the Americans with Disabilities Act, Mr. Sills requested a letter and private right of action so the EEOC issued a dismissal and notice of rights to sue in state or federal court. This letter was issued on April 8, 2024 and a copy of this letter was given to the defendant company.

Hostile and Abusive Working Environment the MGL 151B, the anti-discrimination statute of Massachusetts, shelters members of a protected class against unfair treatment, harassment, and discrimination. Bill S.1185 {it shall be unlawful for any person to engage in workplace bullying or moral, psychological, or general harassment of a co-worker} or other employee in the work place,

 The Defendant’s conduct as alleged above constitutes hostile and abusive working environment. Defendant failed to ensure the working premises were safe. Defendant also failed to pay Plaintiffs overtime took, to which Plaintiff is entitled under Massachusetts law. Finally, Defendant terminated” Plaintiffs employment without any attempts to accommodate Plaintiff, in violation of ADA.

 Defendant’s supervisor, verbally and maliciously threatened plaintiff” as well as other employees, then took actions and carried out, the threat in the form of final termination of the plaintiff’s employment. Other employees were subject to his bullying and harassment.

Retaliation against employees reporting violations of law, or risk to public health, safety or environment remedies.

Violation of part 1 title XXI chapter 149 sec, 185, Massachusetts state law:   

the defendants supervisor conspired with other corporate managers and officers and took retaliation actions to discharge, suspend, the plaintiff permanently from employment, employee had reasonable fears of physical harm because of an unknown suspect utilizing company tools to saw in half a shotgun, that was directly across from the plaintiff’s working area at that time employee immediately left the work area as he suspected a possible workplace shooting.
