I bought a 2002 Mitzubishi Montero Sport from Metro Dodge in July of 2004. I was 9 months pregnant and we needed a larger vehicle. About a month after we bought the vehichle, we had not received a notice to transfer my tag. Then the finance company that had the lean on our Monte Carlo (trade-in) started calling me wanting to know what was going on with Metro Dodge because they had not paid off my trade.

A few weeks later the man at the finance company called me and told me Mr. Jones had wrote him a bad check trying to keep him from repossesing it from the lot. So the Monte Carlo has been repossed and now that is on my credit report and I'm sure there will be legal actions taken against me. We still have not gotten my tag straightened out. We've had two accidents in this vehichle already! Every time we call Metro Dodge no one is available and they give us the run around. Why is this not illegal? Is there not any legal recorse for this business? All we wanted was a safe and roomy vehichle for our new baby and we ended up with this!

I assume that you have all of the paperwork you received when you traded in your car and that the paperwork shows that this dealership would pay off your trade? If so, contact your District Attorney's office and advise them what has happened. As them if you can file charges through them or if it needs to be done in a civil court. CC all information to the Attorney General's office. If the negative information on the reposession is showing up on your credit reports, you need to contact the credit bureaus and advise them that you are disputing the repo in your name because the dealership who took your trade was to have paid it off and advise them you have complained to the DA and the AG. Good luck.
