Michael Grissinger Is it Vivid Design Breached the Contract Took our Money, Did not Do Work, Did not Refund in Jacksonville, Florida
We signed a contract with Michael Grissinger to complete the design of our website (as our location made it difficult to do the work ourselves). He initially bid based on a two-week turnaround time - but subsequently changed it (without notification) to five weeks in the written contract.
We paid a 50% deposit in advance.
After initially working well for a two week period Michael simply disappeared for weeks and months at a time.
We would have to call 5-10 times and email a similar amount to get him to acknowledge a simple request (from overseas so at significant expense). As time went on, it became a matter of threatening legal action to simply get him to do the next part of the work.
He would always make excuses about being busy and being sick. He failed to meet every single deadline.
After five months we gave him a clear deadline to complete the work on the site or provide a full refund. He failed to meet that deadline. He eventually got back in contact claiming that we had provided inappropriate hosting (we engaged an independant company to verify that this was not correct)
As of November 2009 (almost 7 months after paying him a full 50% of our deposit) he has not completed the work or refunded our money.
He (and his web company) isitvivid.com have behaved completely unprofessionally at every stage. Michael knows full well that we are located in a jurisdiction that makes it difficult to legally enforce our legitimate rights under the contract he asked us to sign.
He has taken our money, he has not delivered any work to us. I would seriously urge anyone thinking of working with him to reconsider.
