i was the victim of a theft by deception auction co.

first i was promised at signing contract that i would have multiple advertisng 2 news papers,1 week of news feeds on t.v.

post cards mailed to other auction houses and large flyers printed

well,all i recieved were 30 flyers at $1,200

i phoned him to cancel contract that he was blowing up charges on me he threatened to

tell all other local auctioneers not to take me as acustomer he said he would tell them i was old and crazy.

 than i was promised that all items would be auctioned individually NOT in box lots,as you guess.

all my one of a kind signed art prints, steiff bears, vintage jewelry, tools ,vehicles ,2004' jaguar and 2011' concession trailer.

2011' landscape trailers,

lawn equipment ,antique furniture, etc.the list is unbelievable i have photos of all items anyone could estimate a value per condition.

we were promised to get a reasonable amout estimated at approx 20,000

after letting everythig go so cheap and than adding additional charges literally nickel and dimed us to death

by charging an hourly 12.00 per hr.handling frm drop off (2 weeks) per 3 man hrs

we still dont know what was taken in only that he is paying us 6,000.

its never going to happen

this was supposed to be start up money for a new business. now i am further in the hole because i was planning on replacing my tools and other equipment

Unfounded Accusations on Predatory Auction House

 We DO NOT, have NEVER and definitetly DID NOT deceive this client!  Her accusations were extremely unfounded and very UNTRUE!  The only truth that she has stated here is that we did conduct an auction for her.  We had been warned by other businesses in her community to not deal with her and we should have listened to them!  We also have a signed contract by her stating that she understood how we conduct an auction as well as a tape recording of her when the contract was signed stating the same!   We NEVER quote what an item will sell for or what the total sale will be.  Her "20,000 estimate" is just that-Her Estimate.  This what we call "sentimental value" meaning she has more attachment and gives more value to her items that what the rest of the market place gives it. When buyer's want to purchase items, they prefer them to be in atleast good working order and in good shape.  Hers were not!

1.  She did receive all the advertising that was promised to her AND she has copies of all advertising that was done for her auction.  Yes, we gave her 30 flyers PER HER REQUEST!  The rest were posted throughout neighboring cities, towns, etc. in a 50 mile radius.  Over 800 postcards were mailed out to prospective buyers of her items.  Ads were placed and ran in local tabloids and newpapers that covered an area of over 35 counties surrounding the auction house.  Her auction was advertised on 4 websites and she had T.V. coverage for 2 weeks, not just one week.

2.  We NEVER threatened her with defamation, but she has surely done that to us!  WE tried to cancel her contract but her husband was very adamant that they did not want to cancel. 

3. All large and/or desirable items were sold individually.  Other items that were placed into flats/boxes were first sold at choice item per price, then the remaining items that were left were sold combined.  This is standard practices at most auctions.  Her "one of a kind signed art prints" were NOT actually signed but computer generated.  Her "Steiff Bears" were in such terrible shape and they could hardly be confirmed that they were indeed "Steiff", plus they had holes/rips in the material and the stuffings were falling out.  Her 2004 Jaguar had over 200,000 miles on it and when it was delivered, the water pump had went out and there was a terrible engine noise when it was started!  The car had also been wrecked and was also out of gas when it was delivered so we had to put gas in it just to make the car start!  The 2011 landscape trailer had been damage so badly that the back gate would not even close all the way so that the locking mechanism could not engage.  Their lawn equipment would not run and they refused to pay for a 25cent fuse to atleast make one run.  We paid for the fuse so that they would atleast get a decent price on one of them.  The lawn equipment has also been wrecked and badly misused.

All of the above listed items were also available for online bidding world wide and the rest of the world didn't want her things either! 

The buyer of her 2011 concession trailer was in fear for her life when she had to meet this seller.  The seller refused to sign the title after it had been sold, but eventually met with the buyer to sign the title.  The buyer relayed to me that when they met, the seller jumped out of her vehicle and charged at the buyer with such anger that the buyer almost left and canceled the purchase! 

4. Yes, she was charged $12.00 per man hour on labor but 2 things apply here:  First, she agreed to that on the contract that she signed and; Two, nobody works for free.  What she is not telling you here is that she also was only charged 15% commission on the total sale!  Most auction houses charge anywhere from 25-40% commission.

5. She did know what her total sale was as she was given a Settlement Statement that showed all commission, advertising, labor and expenses to conduct her auction.

At this time, our corporate attorneys are looking at the possibility of a defamation of character lawsuit on this person.
