Midland Credit Management Inc. / fcnb Newport News got letter of impending legal action from midland credit management for fcnb/newport news. have not gotten any bills from this company so did not know i had an outstanding balance. Oaks Pennsylvania
I received a letter from Midland Credit management Inc. Dated 2-6-09.
They are informing me of pending legal action on the behalf of FCNB/Newport News. They wanted to be contacted by 3-8-09. Even though this letter was dated 2-6-09, I did not get it until 3-4-09, PM. I did try to call the 800 # on the letter. Could not get through. I wrote a letter to them and sent them the information that I have. I do not have the minimum $250.00 that they demanded as partial payment. I requested a reasonable payment plan.
Have yet to hear from them. I emailed a letter outlining my circumstances and asked for comfirmation od email and a payment plan.
I was laid off from my regular job a year ago and have just now found work, but it is on a commission basis, and the way the economy is I don't get a regular paycheck and I never know how much it's going to be.
I need to avoid legal action. I do not have money for a lawyer and do not have the money to pay this off. Anyone with any suggestions I will welcome them.

I have had problems with midland as well,I do not know how old of account this is
go online to annualcreditreport check your credit report you can do this free once a year,You need to know what is on your credit report.You also need to know when this account became deliquent then see what midland states on your credit report pay attention of the dates midland states the date of the account
was opened etc..go to this website for your rights it will tell you what you need
to know creditlinksrus.com/credit_reporting_laws.htm.It is illegal for debt to be re-aged as a new debt that's why you need to check the date when this account became deliquent and compare the dates to what midland states on your credit report.Also learn your rights under FCRA and FDCPA.

Be Careful, they use many tactics to scare you. Contact legal aid or your nearest law school for assistance at no cost. They are relentless and will not stop harassing you until you take them to court

First, don't email anyone. You always sent certified, return receipt request letters (with the tracing number written on every page sent and keep copies) only. Emails are lousy proof in a court of law.
Second, sent them whatever you can every month. Make it reasonable although. A few pennies is not reasonable. Twenty dollars is atleast reasonable. If you had to go to court, it proves to the court that you are making an attempt to pay the debt and not cheat the creditor of their monies. It also messes with their computer system showing that their is activity on the account and while it may not keep the collectors at bay, it shows a positive action on your credit report.
