Im going to keep this as simple as possible. MCM knows the debt they are suing my husband for has been paid I have faxed all relevant documents stating this, Credit reporting agencies have at this time deleted it from the files and have sent me copies of their findings. they are now suing us in Civil court knowing all of this they hired a firm (another lawyer from the SD area tells me they are under MCM's umbrella and work for them)its called Harris and Zide womans name is Cynthia that I spoke to, and in one conversation she acknowledges that the debt seems to be paid and will get back to me fast forward to yesterday I get served papers and looking at the dates on the summons they started this paperwork way before they contacted me. So in other words the had no intention of working with us here.


As of today I have contacted several agencies in the government all the way to the state legislature where a gentleman helped me in my pursuit of starting legislation against companies like this. I will still have to go to court and intend on countersuing these entities after all they affected a number of things in our lives...one of which is mortgage rates. So my dears if ya got suggestions or if you want to put a stop to these people join in the fight with me and get these people put in their place. Go to your state legislatures office, District attorney and the attorney generals office you can do so online and most have an 800 number to make it a little easier to get where you want to go! Its an election year lets do it please!

Thank you D for the counsel. I am trying to sift through these legal papers as we speak but also have a lawyer that will represent me in this. This is just all nonsense to me that they are willing to waste the courts time and energy when they know they will lose. I just dont understand this at all.

As for the steps I have taken... my hopes on this is to prevent them doing this to others in the long run. And while it will not help me in the present its worth the try for others, knowing what I went through on a daily basis and all the stress it caused myself and my family I want them to answer for all that they have done and to put a stop to future harrassment to others. Just call it an unselfish act.....

This consumer appears to have spent time and energy trying to reach out for help but contacting the wrong people. Sure, the legislative people may be willing to put something in motion - but that takes lots of time. That avenue will not produce fruit.

I have had the best success, personally, pursuing relief in federal court. The Fair Debt Collection Practices Act, and its state counterpart, is the remedy I would pursue if this were my situation. I have done it and have successfully obtained substantial results.

It seems that if Midland Credit Management chooses to act in bad faith, even in the face of documentation showing the debt has been paid, then it has to face the consequences of its actions. Federal courts can readily see their failure and can give the consumer some relief. Find an attorney, show them the evidence, tell your story and see if the attorney will bring the action.

I have done this (without an attorney) and the results have been thousands of dollars coming my way. Don't give up, fight back. However, don't go into court without some representation - get legal counsel.
