I have been in constant contact with midland mortgage since my insurance company, (who by the way, acted promptly) to get them to release the insurance check issued for damages done to my property by hurricane Katrina.

First, they wanted estimates, which in this area, during the first few weeks of the aftermath, where very hard to get. I found them, faxed them, waited 2 weeks, then called, only to be told my Midland that they needed signed contacts. So I got them, signed them, and faxed them, the day I spoke with Midland, and I waited, and waited, and another 2 weeks went by. My damages were a roof (the entire roof) and the air condioning unit. The check was for $6,900.00.

Finally I did receive a call--from the roofer, who wanted to know when I was going to honor the contract midland had me sign. I explained, they were very nice about, and went ahead with the roofing job, on good faith. The a/c guy wasn't as kind. That was about a month and a half ago. The roof was installed, and afterwards, the house was sold, and midland received their money for the balance of the principal owed. I received no calls from midland during all of this, but I did receive many calls--from the roofer, who would like to paid, and from the a/c guy, who would like the job that our contract states is his, and of course, to be paid.

Midland has promised me (a lady by the name of Gretta, who is supposed to be handling our case) time and time again, that the check "is being sent", "has been sent", "will be sent", and of course, my personal favorite that occured on jan 20th, "where would you like the check sent". That one occurred when they told me the check would be sent on Jan. 16th.

I have today, jan 23 called midland for the last time. They were informed that they have 5 days, then they will receive a rather legal letter from my lawyer, explaining how we are going to sue them for not only the check, but all other expenses incurred during this mess that they did. On a final note, I contacted my insurance company, and found out midland cashed that check months ago. Yes virginia, there is a santa claus...

I'm kinda in the same boat as you. My house was damaged by Hurricane Rita. Damages appx. 16,000. Midland wants me to endorse the check and mail to them. They said they will send me 10% to get work started. They want to send an inspector (at my expense) at 40% completion (7-10 working days) then release 50% more of funds at completion (7 to 10 days). I've yet to send them the check because of my concern about them not paying for repairs rimely. The other reason is I can't find a licensed and insured contrater(required by Midland) to agree to those terms.
