I moved into Bar Harbor Apartments 4/9/10 and the second day I moved in roaches were running out everywhere in everyroom with witnesses to see this.  I moved 1200 miles and nothing that came out of leasing agents mouth was true.  Ants in the 100's also first week.

 

On September 15, 2010 at 2:30 PM, I   went to a Resolution Hearing Downtown Houston to try to resolve the issues at Bar Harbor Apartments.  Tthe Manager and her Regional Manager were at hearing.

 

I went over all complaints and purposed and/or attempted to negotiate and settle situation, as I am packing to move out no later than 10/3/2010.  Most likely before but then I was told I am being sued by Bar Harbor and supposingly there is a hearing on September 30 and as of todays date I have NOT been served.

I have filed a lawsuit against Bar Harbor/Milestone Management, LP/ TMG Milestone Management (Individual to be served CT CORP SYSTEM) on September 9, 2010 at Harris County Justice Of The Peace, Precinct 8, Place 2.

 

The Resolution hearing was to NO avail and I do not understand why they had me drive a 70 mile round trip when they had NO intentions of trying to compromise and or settle.  (Gas and parking costs)

 

Again, Milestone led me on for the second month that they were going to try to work the situation out.

(In reality, they did not intend to do anything in my favor)

 

They keep saying they were going to let me out of my 6 month lease but I became so ill I could not walk and was in unbearable pain and I could not move-I was totally traumatized.  In reality the lease became null and void because pursuant to TX laws there was/is a Warranty of Habitability Issue where after two different times if they cannot rectify the problem the lease becomes null and void)

 

I originally requested a settlement for $700.00 and one month  (the last) as a concession.  They refused this so I filed and asked for a Resolution Hearing.  Prior I filed with TX Attorney General and the BBB and I have spoken to two different attorneys.

 

At the hearing, I went into details regarding all issues of roaches, ants, fleas, snakes, and upstairs neighbors. Also, the untruths regarding the leasing agent and my costs from AZ to TX and the illnesses, doctors, emergency room and therapist etc.   I have suffered terribly which is caused due to the issues here at Bar Harbor Apartments in Seabrook, TX.

 

At Resolution Hearing, I asked for a larger concession/settlement because of the continuing issues.

I requested $1250.00 and one month concession and related I was negotiable.  They again refused any negotiations!  I was more than friendly trying to resolve even though I have been constantly provoked by sarcastic remarks etc.

 

In fact there were insults that I was exaggerating the cockroaches and ants but this is untrue as the roaches were in every room in the apartment the first and second day I moved in.  The ants (hundreds) came approximately the first week or so and my neighbors have seen snakes and killed two. There were witnesses, the manager herself experienced the ants, and I turned in two bags of roaches (German and two American) and one of  (hundreds) ants. One of the Regional managers stated she had a snake killed in front of complex) But according to leasing agent there were no pre-existing roaches, ants snakes, fleas, or trashy balconies etc, etc.  (All before my move in and my five phone calls to Bar Harbor I was told none of above existing) Bar Harbor/Milestone Management has chosen not to be honest about details. In fact, everything that came out of the leasing agents mouth was false. 

 

I allowed many (as Orkin) in my apartment to use toxic chemicals to attempt to rectify the infestation.   The apartment was NOT exterminated before my move in even though I requested this.  Most all my neighbors related they had roaches and my upstairs neighbor stated she had roaches and ants and she used non-toxic products because of her cats.  I also have cats and the one became ill due to the chemicals/powders etc.  The roaches attacked the cats food on two separate occasions as the ants came in hundreds on there food.

 

I became very ill with a bronchial infection (had to have an inhaler) and severe depression and my sciatic nerve became inflamed due to lying around on the sofa in deep depression because I never could totally unpack and make a home and I lost my job working with children due to being ill with Bronchitis.  My world became dark do to my move to Bar Harbor Apartments and dealing with rodents and rodent bites.  In the last month, the new upstairs neighbors who moved above me have become the neighbors from hell.  Some believe as I do that this was done by management in a maliciously and deliberate manner to harass me.  This 4-plex area was rented out to those over 60 years old and the lady who moved out was sick and tired of the issues at Bar Harbor and was 56 years old.  We had No issues!

 

I have now suffered banging, slamming, stomping and trash thrown down on my downstairs front porch area.   This has gone on several times after midnight as the trash piled outside of their door.

 

I have reported in writing and via phones calls to management only to be told by leasing agent she was too busy to address.  This leasing agent also related to me she was sorry for what she did by leasing to me and not listening. 

 

In all my life, I have not lived in such conditions and I am very frustrated to relate that Bar Harbor Apartments/Milestone Management will go to the point of lying to keep their job and or cover up the truth.  It should be lastly noted that I have followed the law by sending certified letters to Bar Harbor Apartments timely regarding the rodent problems.  They seem to not acknowledge this and feel they are above the law and any code of decency!  They have led me on right until the middle of September which is when I distinctly related I am moving out and I will not be paying Septembers rent because I felt they own me a concession and compensation for the untruths and the pain and suffering I have endured in the 5 months I have lived here.  There remedy was to toss me out and cause me to lose my job and or become homeless when they should have exterminated this apartment pre my move-in and most of all been honest and told the truth that Bar Harbor Apartments as real issues with c**k roaches.
