April of 2010, I contacted 1-800-CASHOFFER/Ron Murcheck about buying my home. I am a single mother and I had just lost my job of 3 ½ years and rather then getting behind in payments, loosing my home and messing up my credit I thought this was a good option.
I "thought" I was selling my home for the value of the note payment. My understanding was I would walk away with no money in hand, but I would be out from under the note and my credit intact.
What really happened is I signed over my deed to 1-800-cashoffer, represented by Ron Murcheck, who then "sold" the deed to Dan Heskett, who then "sold" the deed to the current home owners.
Seven months later nothing has changed the bank note is still in my name. My insurance company has now canceled my home owners insurance because I am no longer the home owner/deed holder. Now the bank will be notified and my understanding is they will put on their own insurance. I am responsible for that insurance as long as that note is in my name.
The reason the insurance company found out that I was no longer the home owner is because after the "sale" Dan Heskett contacted my insurance co. apparently on "my behalf" and filed a claim on the roof after he agreed to buy the house "as is". I found out because I received the notice in the mail. I contacted the insurance co. found out what happened and tried to cancel the claim but the check had already been issued. I did give Dan Heskett the insurance information thinking of course he needed it; after all I sold him my house. I did not know he was going to file a claim under my name. I felt his was very underhanded.
I contacted Dan Heskett about this and asked him how in the world did he think he was going to get his hands on the check and how did he think he was going to cash it when it was made out to me and the bank. He fumbled with his words never had an answer except to say that I knew what was happening and that is why I gave him the insurance information. Are you kidding me!!
It was at this time that I started to realize that this was not happening the way I thought it was supposed to. I expressed to him the he and 1-800-cashoffer did not explain things right to me. I would never had made this deal if I had understood that I was to keep the note in my name until such time as the new home owners can establish credit and assume the loan. Which I am also now being told can take a year or two! Would you believe he told me to stop acting like the victim here that I knew d**n well what I was getting into!
I then contacted Jeremy Brandt, CEO of 1-800-cashoffer and had a very lengthy conversation. He indicated to me that it was really out of his hands but he would look into and get back to me. I never heard from him again.
I have copies of the papers that were sent to me to be signed and or notarized but I never received anything back signed by anyone else.
I have sent 3 emails to Dan Heskett informing him of the insurance situation and also asking the status of the new home owners taking over the loan but he has yet to answer. I have not called him due tp the fact that each conversation with him has gone bad and I wanted proof in writing that I have tried to contact him. I don’t understand how there can be no communication as long as that bank note is still in my name.
Do I have any legal rights here!!!????
If not, how long can this legally go on? What if the new home owners can never take over the loan?

UPDATE: I have now also spoke to the new deed holders and they too, as I expected, are extremely upset. They did not know until after they paid their 10000k and signed all paper work that the note was in my name. They were led to believe from Dan that he personally was the note holder and that he would owner finance the loan for 25 years.  They also indicated that there never was a plan to put this note in their name!!!

So what I am suposed to wait 25 years to get this note out of my name!!! This can not be right!!!

I am going through a similar situation with Dan Heskett here in 2013..my home is being forclosed on in 2weeks...and Dan cant be sued..what can we do?
