MN auto Finance Richard Lara Kept my car for repair for 4 months and never returned it or the downpayment. Humble Texas
I purchased an automatic 2006 ford fusion sel in the earlier part of April 2013 with a 90 warranty. I drove the car off the lot knowing that it had an oil leak and the air bag light was on. During the first 2 days of driving the car I noticed a loud rattling noise coming from the front end of the car and when the car would shift into 3rd gear the transmission would give a very hard jerk and also after the car was started, ac turned to on and putting the car into reverse the ac would make an awful screeching noise. The car also had damage to the exterior driver side door trim in which the dealer stated they would not fix. I notified MN Auto finance of these problems. I took the back the following week and they fixed the oil leak and stated that the rattling noise was fixed and stated that did not hear the ac noise. During this time the car kept was for repairs for one week.
The second day after picking the car up from the first repair my husband noticed the rattle noise again, so I called the dealer and I dropped it off the following Wednesday. While the car was being repaired for the second time the dealer stated that the part had come in for the air bag light. I called the dealer after 3 days in repair to ask for an update on the repairs. The sales person Nathan told me that ford dealership had put the airbag censors in wrongly and they had to do it all over and the rattling noise was fixed. The sales person called me back about 4 days later wanting me to pick it up after 1 week and half at the dealer repair shop. After picking the vehicle up we drove it straight to get it inspected. During the drive I noticed again the loud rattling noise from the front end of the car. We proceeded on to get the inspection sticker replaced in which the car failed the TSB report. The inspection company advised me to drive it for a day then bring it back. I drove the car and took it back the next afternoon in which I was given a new sticker but was told under state law I had to get those issues repaired on the TSB report. The transmission jerk and the rattle noise were on the TSB report giving specific results as to why and what the problem maybe. The next day I call MN Auto Finance and the sales person proceeded to tell me that he does not hear a rattle coming from the hood. I asked to speak with the manager Scott. Scott advised me to bring the car in and perform a test drive with Willie the mechanic for the second time. I took my car in again for repair. To this day my car has been there for 3 weeks and 2 days for repair with no results. On Friday July 19, 2013 I called the dealer as usual to seek an update on the repairs. Scott called me back about 2 hours later stating that I pick up a loaner car in order to keep me from calling them every day about my car because I was calling too much. I opted to refuse the loaner car because we do not want to be financially responsible. On this day of July 5, my husband spoke with Scott and Sylvia this morning and inquired about the vehicle. We asked for our money back and we were told that they cannot do that and to just bring the car and keys and it would not go on our credit. MY husband reminded Sylvia that we have not been driving the car for the past 4 months and we have not had the car for the past 3 weeks.
Note: Since my car has been going through repairs I have called and called to get results. I have filled a payment amendment due to the fact that I have am paying for a vehicle that I am not driving and I have maybe put 400 miles on the car in 4 months. I was told the amendment was being reviewed. I have missed paid one car note payment and I have another one due today July 5, 2013. I was told that if the amendment is not approved I will have to pay the note. After exhausting my attempts with the location I purchased the car from, I placed a call to the main building where the district manager resides in which the finance sales person advised me to call Scott. I told them I did and I have been speaking with him and I have not gotten any results. Each time I called for the district manager Richard, I am told he is not there or in a meeting. I have been very nice and understanding about this situation but I have been told repeatedly of how expensive this is costing them for the parts and I shouldn’t be mad because I am not paying for anything and also of how they are tired of my car being there. I am completely speechless and wondering why they would even have a car sitting on the lot for sale with these noticeable issues. I am very distraught and drained and drained from dealing with this issue. I have always had a very pleasant attitude but have stressed my concern about my car problems. I have to put wear and tear on my husband’s truck. My husband is a deputy constable for precinct 4 and I work Hewlett Packard. When he returns from work overnight I leave in his truck. This is an inconvenience. My mother came in from out of town and left her car so I wouldn’t have to pay anyone. At this point we are asking for our down payment back .
July 8, 2013 Adrian Hall (my fiancé) received a call from Richard Lara (general manager for MN auto). Mr Lara proceeded to apologize for being rude over the phone from the following day and stated that he wanted to give Monica Smith a loaner while the 2006 Ford Fusion was being repaired by a ford specialist. Adrian Hall contacted Monica Smith and she agreed. Monica Smith drove the car for 5 days. Monica Smith returned the call to Silvia Palomo. Ms. Palomo and Monica Smith have spoken on a number of occasions about the Amendment to vehicle installment contract. This amendment would give new payment dates for the ford fusion since it has been in repair since the week of purchase. Silvia stated over the phone to Monica Smith on July 19, 2013 that there would not be a payment until July 26, 2013 because she would have to speak with Richard Lara and have him sign and email new documents so that we all can agree to the new re-arranged payment dates.
July 13, 2013 MN auto called Monica in order to receive a payment for the ford fusion that has been in repair for over a month. I spoke with Richard Lara who was very rude and stated that, 'I only gave you the loaner car in order to get a payment and the ford fusion is not a the ford specialist'. Monica Smith proceeded to notify Mr. Lara that she has spoke with Silvia for the tenth time and no one is doing what they agreed to do with the amendment form. Richard Lara stated that the loaner will be picked up if Monica SMITH do not make a payment for the ford fusion. Richard stated that he would not give Monica Smith her down payment or the already purchased Ford Fusion back to her possession. Richard began to be very rude and call Monica Smith a liar and stated that once he towed the loaner car back to MN auto he was going forget I ever existed. July 16, 2013, I have not received my down payment or a call from the dealer.

The loaner car was towed away and taken back to MN auto Finance, Humble TX on July 20, 2013.
I Monica Smith had no problems paying my car note but this dealership has never honored any repairs or amendments. Richard Lara is very rude and dishonest. This has caused me to loose time from work due to filling complaints with other agencies. I have given MN auto Finance my hard earned money just for them to take it and do as they please. I will have to purchase another vehicle from another dealer for more or the same amount I paid to MN. Please help resolve.
