 I bought my car from mobile auto sales they let me drive off the lot without any insurance. Then one night at 2:36 am my car alarm was going off I go outside to check out the scene and my car is gone. So I call the police they come out file the report. Minutes later the police station call me saying they found my car I asked who has my car they respond the people you bought your car from,I asked why they took my car, the police told me I had to talk to the people I bought the car from I said okay and that was the end of the conversation. So the next morning when I wake up I call mobile auto sales and ask them why they take my car they said because you didn't have insurance and I said well y'all let me drive off the lot without insurance, they didn't respond so I simply told them I would be there to get my car with the insurance mobile auto sales said ok but there will be a reposition fee so I asked how much they didn't answer.

So I didn't get to make it there that day, but the next day I called again and asked how much would it be too get my car back they told me I had to pay 4500 to get my car back the rest of what I owe them so I said ok I will be up there to talk about this. I went up there that day I asked can I get my stuff out the truck the man kept asking for the keys so I was skeptical about giving him the keys because I didn't want to give him the keys and he resale my truck. I recorded the conversation between be and mobile auto sales. So will(the owner) calls the police the police make will(the owner) let me get my stuff and my baby stuff out the truck. He told the police and told me that he didn't want to do business with me,but did not want to give me my money back when I asked for it that I put down. I haven't even had the car for a month. I am asking for this to go to civil court or something just to get my money back that I put down which is 2000.

It is apparent that you did not read the contract, as Jim pointed out in his post.

You are the one that defaulted on the loan by not having insurance per the contract. Therefore the court would have to side with the auto dealership/lender that repo'ed your vehicle. You would not get your funds back.  It is also very possible that you still owe the entire balance of your vehicle loan, less the amount the lender gets for selling the vehicle due to your default plus fees for the repossession and auction fees.

That $2000 is gone. The best thing you can do is mitigate your damages now with the lender. Make an arrangement for a settlement so it doesn't go to judgment.

Do not sign any contract without reading it and understanding it entirely.  Any verbal statements by the auto dealer representative do NOT over ride the written contract. In fact, it is common for many auto dealership reps to misrepresent the terms of the contract verbally knowing full well that verbal statements don't count. How do you think used (and new) car salesmen got their well deserved poor reputation?

You would be better off having an attorney read the contract and explain the provisions to you. Take care of this now so it doesn't hurt your credit for the next 20 years (with a judgment it will be on your public records for up to 20 years).

The CONTRACT tells you the terms and conditions of the sale.  One of those terms and conditions is YOU must carry full coverage insurance, which is STANDARD for any financed car.  Without regard to what the salesman told you, the CONTRACT is what governs the deal.  If YOU would have read it, then YOU would have seen the discrepancy between what the salesman said and what really matters...WHAT THE CONTRACT SAYS.  You can take this to any court you wish.  The bottom line is the CONTRACT states you MUST have insurance.  YOU chose to NOT have insurance.  Nobody to blame here but YOU because YOU chose to NOT have insurance.
