Stay away from Modern Window New York located in Buffalo NY.  They will call your home and offer you a free estimate on replacement windows.  If you agree to the free estimate they will then illegally run a hard inquiry on your credit report and any other adults in your home from Equifax without obtaining legal consent from you.  They can do this without a social security number by only using your name, address, and phone number.  When you contact Equifax to report the inquiry as fraudulent they will not remove it, and will instead inform you that hard credit inquiries are a matter of fact. 

When I contacted Modern Window New York to question them on this practice I spoke to a man named James who was not forthcoming with information.  He told me that the person who contacted me was named Gregg and that Gregg should've told me during the phone call they Modern Window was going to pull a credit report on me.  However, Gregg never said anything about a credit report, he just told me I was going to get a free estimate for replacement windows.

Modern Window called again yesterday, now claiming that if I qualify I can get a grant to replace my windows at no cost to me.  These people are liars and cheats and I would advise anyone considering replacement windows to steer clear of these conartists.

Modern Window maintains an "A" score on Angie's list and an "A+" with the BBB. The important thing for us to remember as a company, when faced with such damaging allegations, is the completely satisfied customers throughout western new york numbered in the thousands, with thousands more REPEAT customers who have trusted us with their improvement needs 2, 3, and 4 times.

Modern politely requests permission to check credit on ALL of our consultations. This is to provide as complete a picture as possible as to the financing programs available, in order to assist our customers with the most affordable options with which to purchase.

All those asked have the opportunity to say "no". In the body of the federal Fair Credit Reporting Act which gives guidelines to those pulling credit on consumers, there is nothing illegal in doing this.

This same individual who filed this "complaint" is the same individual who also filed a complaint against us with the BBB a couple of weeks ago. This complaint has since been closed as "SATISFIED" by the BBB and our company has WITHDRAWN the inquiry with Equifax. That should have closed this matter then and there.

Our company is composed of well-meaning individuals with families and concerns of their own. Each and every employee here at Modern takes great pride and OWNERSHIP of it's long-standing reputation in the communities it serves.

Complaints such as this just makes everyone's job just a little harder even though they are so extremely few and far between. (We have only THREE complaints with the BBB on record from over the last three years against the reality of having dealt with thousands of consumers. This latest complaint is one of these three. Making things interesting, complaints generate from NON CUSTOMERS 99% of the time).

We ONCE AGAIN apologize for the misunderstanding and we reiterate to this individual that the inquiry with Equifax has been withdrawn.  

I would politely request this this individual do what I believe to be the right course of action and, in the interests of our family here at Modern and of the future clients in need of our services, withdraw this complaint with the assurance that we have done all we can do to set this right.
