I signed a contract and handed over a check to Luke Rosalind from Momax for 40% of the cost of the contract. I do believe at the time I signed the check and gave it to Luke, he knew the company was in trouble.

Like all of the people who have filled out a report on Momax, I was made promises that the job would start "next week". Next week went on into a month, 2 months, 3 months ... it now has been 6 months.

I was told by an "employee" of the company that Fred hasn't been paying his people, that the cabinets for my kitchen were "in" and had been "in" for months. The problem was that Fred didn't have enough money to get them out of some warehouse. I went through the process of sending a certified letter to have Fred refund my money. After 2 weeks of that, I went to a lawyer.

I filed a complaint with the Attorney General's office and received a letter from the stating that they felt this was a Better Business Bureau issue and they weren't going to proceed.

I filed a complaint with the Better Business Bureau and said that I wanted to start arbitration. I received a letter last week stating that they sent a letter to the company and was awaiting his response.

My lawyer said "It sounds like this guy doesn't have any money to refund your money. Why throw good money after bad? You could get a judgement against him, but if the money isn't there, what will you gain?"

I am not sure where to go now.

Just wanted to let you know I obtained copies of all the complaints against MoMax to the attorney general's office. There have now been 8 since October. I saw a complaint I suspect was yours and was incredulous that they thought the BBB would be able to do anything for you. I received a response to my complaint today, and they have sent Fred a letter. It appears that with the increasing number of complaints, they may be taking this more seriously. Same is true for Cook County State's Attorney, so if you haven't, give their office a call. I'm not sure how it works, since I assume you are in DuPage county. Since MoMax operates in Cook, I'd report things to both counties. Look at the thread for Marny from Elgin - read it all and you can figure out how to get in touch with her directly. She knows how to reach me and others. -Jennifer

You ask what you can do, you can file a complaint with the Cook County States Attorney's office. You can also send an email to the investigative reports at NBC, CBS and ABC.

If you sit back and do nothing, Fred will just continue to take money from other people and there will just be more people in the same situation that we are.
