I'll make this pretty straightforward. Momentum Telecom despite assurances when I was signing up that no other type of billing aside from their described terms and use of a 3rd party verifier doesn't live up to their terms. Any advertisements you get from this company will not mention the fact that their "unlimited" plans are in truth not unlimited and have a minutes per month cap that includes local (within your own city) calls.

Now this was of particular concern to me as I used the Internet a lot for chatting, email, and entering sweepstakes. So I might spend 3 or 4 hours a night online. I think it was 5000 minutes a month that they give you in their supposedly unlimited plan, but the cap isn't mentioned to you till you exceed the amount and get a $50 charge for each month you exceed that limit.

Can a company even say that a service is unlimited if it has a definite limit to your minutes and wouldn't a charge have to be mentioned in either the main sign up or in subsequent fine print on any agreements or billing? It seems insane as they could just as well charge $1,000 under these sketchy terms where no charges have to be justified except under their own terms they never reveal.

I took the fellow from TN's advice and contacted the Kentucky Public Service Commission concerning this matter.

Momentum Telecom at this point still has not removed the two items of $50 charges concerning exceeding their "Unlimited" 5,000 minute plan.

I was duped by the same dishonesty. I was not charged since I haven't exceeded the 5000 minutes, but it doesn't give me peace of mind having to count.

A supervisor has not been available within the past 2 days and has not returned my calls. The CC representative told me most companies have a limit to their "unlimited" and won't tell you until after the signup. Firstly, I said, that's called lying and is probably illegal. Secondly, I called my local company whose unlimited IS unlimited.

If I don't get a call back today, I am filing a complaint with the Tennessee Regulatory Commission who will investigate and provide for a resolution. If you file one,too, it may give us more power AND get your money back. The # for your state should be in the 1st pages of your phone book.
