Please accept this letter as a formal complaint against Big Sandy Rancheria, DBA Mono Wind Casino in Auberry, Ca.

The specifics of my complaints are:
1) That the administration of the Casino, specifically, the Human Resource Department unlawfully denied me sick leave benefits due as stated in the Employee's handbook. My loss of sick leave wages was 4-days pay, approximately $240.00.

2) That the Human Resource Department withheld funds
from my paycheck for insurance premiums and failed to forward those premiums to the insurance provider with the result that I did not have insurance coverage.

3) At the time of my termination, the Human Resource Department withheld final paycheck for more than 72 hours in violation of California Labor Code 201 (a).

4) That the Human Resource Department refused to accept a letter of assignment for my choice of treating physician for any worker's compensation claim 30-days into the future.

These violations took place in December of 2003 with the exception that the insurance premiums were withheld from August 2003 through December 2003, and the refusal to compensate for sick leave occurred in September-October 2003.

Since I have paid income taxes to California during my employment with the casino, I expect California to protect me from employer labor violations. I am requesting that your department investigate my allegations and, when found to be true, take action against the Big Sandy Rancheria and the Mono Wind Casino.
