HERE IS HIS FINDINGS ALONG WITH HIS PARTNERS FINDINGS, REMEMBER BOTH RETIRED POLICE OFFICIALS WERE FROM DENNIS WARDS BACK YARD WHEN HE SERVED ON THE POLICE FORCE IN MIAMI...
"This case is being presented on behalf of Robert and Laura K / "Reef Snorkeling Adventures, Inc". and Captain Kevin Mc of "Amelia River Cruises and Cumberland Sound Ferry Services", who have been victimized on multiple levels as a result of the failures of Florida Law Enforcement Officials, Private Citizens, Private Attorneys, The State of Florida Legal System and The United States Federal Legal System, some of whom have systematically engaged in what appears to be inattention to facts, ineptness, illegal acts, neglect, official misconduct, cover up and outright deceit. "Dear Mr. Ward,
My name is Richard A. Block and I am Secretary of the National Mariners Association.
I was contacted several years ago by Mr. K who reported his documented small passenger vessel was stolen, damaged, and sold without his permission in Monroe County, Florida. Our Association, which speaks on behalf of about 126, 000 "lower-level" mariners throughout the United States who operate vessels like Mr. K's. We became interested in his case and carried an article in our Newsletter in March 2007 (attached). We also reported this case to investigators from the Department of Homeland Security and saw to it that Robert reported it to the Seventh Coast Guard District in Miami, FL.
Since then, I have been in constant touch with Mr. K and find it incomprehensible that after the number of public officials that he has contacted in every conceivable branch of State government, that the State of Florida and/or its political sub-divisions appear to be incapable of bringing this matter to a successful conclusion."

Just looking at your complaint I see you must be a spelling major. At least Mr. Ward pursued cases instead of just giving away probation sentences to VIOLENT offenders and withholding adjudication. His replacement Ms Vogel should be impeached, as she doesn't even tell the victims of violent crimes that oh she doesn't want to spend the $ to prosecute a sure win case after the offender admitted his crimes under oath but is rich so we will just give him probation and not bother telling all his victims oh by the way we dropped charges on a sure win case because it would cost too much to put a rich kid in jail. Ms. Vogel should be IMPEACHED. And Dennis Ward reinstated because at least he worked for justice.

LAWYER SAYS STATE ATTORNEYS INVESTIGATOR WHO HANDCUFFED DRIVER AFTER MAKING TRAFFIC STOP MAY HAVE VIOLATED MANS CIVIL RIGHTS
STATE ATTORNEY WARD SAYS HIS CHIEF INVESTIGATOR CONDUCTED INQUIRY INTO TRAFFIC INCIDENT BUT DID NOT WRITE A REPORT OR TAKE ANY NOTES

Last week, we published a story about Andrew Kempel, a 35-year-old investigator in the state attorneys office (SAO), who chased down Everette Wilson, 45, handcuffed him, called the Key West Police Department for backup then wrote Wilson a traffic citation for driving the wrong way down a one-way street in Bahama Village. We dont make this stuff up.
Wilson said that, as he was parking his car near the Whitehead Street apartment he shares with his wife and two grandchildren, a man wearing a gun approached his car, opened the door on the drivers side and, with his hand on his gun, demanded that Wilson get out of the car.
Wilson said that, as soon as he stepped out of the car, the man handcuffed him. He said that when he protested, the man told him to shut his mouth. According to the police report, when the Key West cops showed up on the scene and asked Kempel why Wilson was being arrested, he told them that Wilson was not under arrest.
When they asked why he had handcuffed Wilson, Kempel told one officer, because I wanted to. He told another officer that he handcuffed Wilson because he had yelled at him.
Wilson denies that he yelled at Kempel. Wilson also said that Kempel, who was dressed in civilian clothes, never identified himself as a law enforcement officer. Key West police officer David Kouri, the first officer on the scene, wrote in his report that he did not see any activated emergency lights on Kempels vehicle.
To write the traffic ticket, Kempel had to borrow a citation book from one of the police officers. He also had to borrow a key from one of the officers to unlock the handcuffs that he had placed on Wilson. His handcuff key was apparently on the same key ring that he uses for his car key and he had left his car key in the ignition switch of his car.
In a two-page statement emailed to Key West The Newspaper last week, Assistant State Attorney Mark Wilson said that, while SAO investigators do not normally make traffic stops, there is no question that Kempel had the legal right to stop Mr. Wilson.
A review of relevant state statutes this week, however, seems to suggest that SAO investigators do not have the authority to enforce traffic laws in the state of Florida. The relevant law is Florida Statute 316.640, which defines which officers have the legal authority to enforce Florida traffic laws.
If the argument that Assistant State Attorney Wilson has made is valid that any sworn law enforcement officer in the state has the authority to enforce traffic laws FS 316.640 would not have to be more than a sentence or two long. All it would have to say is something like this: Any sworn law enforcement officer in the state of Florida, as well as other officers specifically listed in this statute, have the authority to enforce state traffic laws.
But the law does not say that. Instead, the statute goes into minute detail, page after page, to specifically list every single type of law enforcement officer, in every agency, who is authorized to enforce traffic laws at the state, county and municipal level. And the list does not include SAO investigators!
The job of SAO investigator is a state position. The list of state officers authorized by statute to enforce traffic laws starts with the Highway Patrol and the Florida Department of Law Enforcement. The list also specifically includes officers of the Florida Fish & Wildlife Commission and the Department of Transportation.
The list also specifically says that university police officers have the right to enforce traffic laws on university property and airport police officers have the authority to enforce traffic laws on airport property.
Got the picture? The intent of this statute is to list every single type of law enforcement officer authorized to enforce state traffic laws. The list is very detailed and specific and SAO investigators are not on the list!
But lets cut out all the bull here! What really happened on the morning of Tuesday, July 28, had nothing to do with public safety or who may or may not have the authority to enforce traffic laws. Everette Wilson did something that morning to piss off Investigator Kempel, and Kempel chased him down and used his badge to punish him! Kempel knows that. Kempels bosses know that. And the Key West cops who showed up in response to Kempels call for backup also know that.

According to the written explanation sent to us by Assistant State Attorney Mark Wilson, Kempel was sitting on Angela Street, in his unmarked vehicle, at the intersection of Whitehead Street. Everette Wilson was on Whitehead preparing to turn left onto Angela. Angela is one-way west of Whitehead.
Andy gestured to Mr. Wilson that he couldnt turn left onto Angela, but Mr. Wilson turned left anyway and drove around Andys car and headed the wrong way down Angela. Andy considered this a serious enough threat to other traffic that he turned around and stopped Mr. Wilson. As for handcuffing him, when Mr. Wilson got out of his car, he apparently was quite belligerent and Andy placed him in handcuffs for his own safety and called KWPD to back him up, Assistant State Attorney Wilson wrote in the statement sent to KWTN.
But Assistant State Attorney Wilson wasnt there.
Everette Wilson was there and he says he was not belligerent. Investigator Kempel was also there, but we are told that he did not write any kind of incident report.
We also know that State Attorney Dennis Ward was concerned enough about the incident to ask his chief investigator, Anthony Pizzo, to conduct an inquiry. That inquiry included interviewing the three Key West cops who ended up at the scene. We assume that it also included an interview with Investigator Kempel.
We also know that when Pizzo showed up unannounced at Everette Wilsons apartment, Wilson refused to talk to him. We made a public records request to look at Pizzos investigative file. But State Attorney Ward told us Thursday morning that Pizzo neither took notes nor wrote a report.
Thats what Ward told us and we want to believe him. But wouldnt you think that the very first thing you would learn in investigator school is to take notes as you are interviewing people as part of your investigation? And even if a final report is not written, those notes would end up in an investigative file along with other documents, like the KWPD incident report and, maybe, copies of internal emails?
But, of course, once the investigation is closed, the investigative file would become a public record available upon request to reporters and others.
So, if for one reason or other, investigators do not want to create a public record, they simply conduct their investigations without writing anything down. That sounds absurd, doesnt it? But that is what we are being told happened here.
A state attorney investigator suddenly decides to make a traffic stop and handcuff the driver for his own safety. But he doesnt bother to write any kind of report to explain his bizarre behavior.
At the request of the state attorney, the agencys chief investigator conducts an internal investigation. And he not only doesnt write an investigative report, he doesnt even take notes!
Do we sound jaded? Probably. But keep in mind that we have been watching Key West and Monroe County government for years.
But to be fair, we will tell you that State Attorney Ward called us twice to confirm that, in this case, there are no notes, no reports and no investigative file.
We do not condone the violation of traffic laws. And there is no question that Everette Wilson drove the wrong way down a one-way street. But even assuming that Kempel had the authority to make a traffic stop and write a ticket, the handcuffing seems a bit over the top. Everette Wilson is contesting the ticket and has retained Attorney Sam Kaufman to represent him at a hearing scheduled for September 1.
Mr. Wilson will ask the court to dismiss the citation based upon the investigators lack of authority to issue the citation in the first place, Kaufman told KWTN Wednesday. The circumstances of the issuance of this citation are certainly unusual and raise questions whether Mr. Wilsons civil rights were violated.
