Complaint Review: ePenzio Inc.

Monterey ripoff Salt Lake City Utah

On April 29th 2002, I attended one of the NGC Seminars with my father. I own a computer business and my interest was peaked when I heard how easy it would be to set up an on-line merchant account. Probably 90% of the people in that seminar (myself included) signed up....I feel the word SUCKER written across my forehead. I paid $100 down and set up automatic deduction from my checking of the $99 per month payments on $3600.

Within just a few weeks, I had deductions coming out. My accountant was going nuts because you couldn't tell who was deducting what and what for. After several calls, I found out that different little hidden charges where coming out. My ePenzio
contract was sold to a company called Monterey Financial.

I was given the Visual WebTools v4.1 also. I'm a Computer Analyst. I still had difficulty trying to create a WEB site. I felt extremely humbled because of the difficulty I was having. I attempted to get assistance from the Pacific Webworks, Inc. and basically got the run-a-round. After this I employed a gentleman to build a WebSite. He reassured me that the Visual WebTools was junk and basically a FTP tool. Unfortunately, I wasn't getting any support from the site it FTP'd to.

I made several calls to ePenzio and on every occasion was basically told they were ONLY responsible for setting up my merchant account....Nothing more. It is now December and I still don't have a live merchant account. I closed that checking account and suddenly I'm getting calls from Monterey Financial...
But no one else. Unfortunately, Monterey wants the $2500 balance they purchased from ePenzio. As a future reference, please be advised that you can set your own merchant account up locally and know who your dealing with FOR UNDER $100! Build a professional WEB site for under $500.

#8Consumer Comment

Tue, November 04, 2003

My complaint has been listed elsewheres on this ripoff site and yes, I have filed my complaint with Utah's Consumer Protection Agency and with a Mr. Ao Pauga in regards to ePenzio as well as Monterey Financial Services. My husband and I wimped out and paid off Monterey Financial Services just to get ePenzio off of our back. Ao P. says that I can't file under Utah's Consumer Protection Agency about MFS as they're located in Calif.(ePenzio's in Utah). I think that there has got to be a way to deal with this and to recoup some of the lost $$$ from Monterey Financial Services----can anyone out there advise?? Many thanks in advance. Please post your info below..

They pulled the same crap with me, only I never made one payment to them.

Galaxy Mall sold my husbands contract to Monterey FS and they threatened to ruin our credit if we did't pay up.

Please email me and share the paticulars of your experience.

I am certain this must be the same company.

Rebuttal to Comments made by CEO ..I called the support numbers on numerous occasions and could not get any real support

#8Consumer Comment

Thu, March 06, 2003

First of all, the 8 different places the CEO talks about were mostly formality. You have to initial stating that the info is true. Basically protecting Epenzio in this case.

However, you notice that no recordings are offered from the speaker. I'm sure that nothing binding is said.. only insinuated. I'm a computer analyst and I immediately started using the WEB Wizard the CEO refers to. I spent a week with no luck.

I called the support numbers on numerous occasions and could not get any real support. Thinking that maybe I just didn't have the creativity, I hired a WEB designer and ask him to use my WEB Wizard. I quote "Its Junk" after trying. We used Dreamweaver. I then proceded with several more phone calls to get my shopping cart he refers to. I was told that this would be an additional charge. From May 21, 2002 when I got the HA HA package, I spent the next couple of weeks finding out about how little I got for my money.

Bring it on Home DOES NOT support shopping cart...another one of those extra costs. I was allowed to change to authorize-net but it was because the the substandard service of Bring it on Home.

Unlike what the CEO says, I never talked to anyone who didn't eventually refer me to someone else.

Oh by the way...only a few other gateways were compatible with what was offered. I did inquire about a credit card machine. By June 14, 2002, I was just trying to make the best of what sounded like a good deal but had terribly gone wrong.

I should have read my contract closer. I would have realize that I basically paid $3,600.00 for really some useless software and a prearranged merchant account that I could have gotten FREE.

Since this expensive lesson, I have set up my own local merchant account...Ecommerce and WEB site and....I'm creating WEB sites/hosting. My fee is $300.00. For that money, I create and register your site for you and host it for $40.00 monthly.

My total cost for my own work was under $100.00. Please Mr. CEO, tell me what the $3,600.00 covers. As for your offer to sell mine, I decline. I would not feel right with someone getting stuck with the same...HA great deal.
Signed LESSON LEARNED!

P.S. I also have on-line Shopping Carts!

The facts about David's contracts with ePenzio.

#8REBUTTAL Owner of company

Wed, February 05, 2003

I am sorry that David feels that there is a problem with the Website package that he purchased from Bring it Home or the PenzPay Internet Payment Gateway that he purchased from ePenzio that would have caused him to have to seek a remedy by this means. I have read Davids complaint, reviewed all of the contracts that David signed, reviewed all of the notes in the Bring it Home database and the ePenzio database concerning Davids accounts, and I found the following:

1. David purchased his Website Package, which included a Website, Web Wizard and Shopping Cart, for $99, and applied for the financing package for his PenzPay Internet Payment Gateway on April 29, 2002. The contracts that David signed on April 29, 2002 required David to sign in 8 different places. David was given copies of all of the contracts that he signed, so that he could review them at his leisure.

2. David had until May 2, 2002 at midnight to cancel his applications and eliminate all of his obligations concerning these contracts. Neither Bring it Home nor ePenzio received a cancellation notice from David during this time.

3. David received the Website Package that he purchased at the time of purchase.

4. On May 14, 2002, David called ePenzio to inquire about the progress on his account. He was informed that his account should be completed shortly.

5. The package that contained the Login ID# and Password for Davids PenzPay Internet Payment Gateway transaction system was delivered to David by FedEx on May 21, 2002, FedEx tracking #476963417869 (look it up at www.fedex.com if you want). It appears that an E. Spears personally signed for the package. Upon receipt of this package, David had everything necessary to operate his PenzPay Gateway system.

6. On June 13, 2002, David called ePenzio 2 different times with questions about his Website. He was given the phone number for the Bring it Home technical support staff. David also had questions about logging into his PenzPay Payment Gateway. The ePenzio representative walked him through the login process step-by-step.

7. On June 13, 2002, someone who stated that he was calling on Davids behalf, called Bring it Home and asked some general questions about Davids Website.

8. On June 14, 2002, David called ePenzio and asked if he could use a different Website with his PenzPay Gateway. The ePenzio agent informed David that he certainly could and if the PenzPay account was not compatible with his new Website hosting services, that ePenzio could exchange his PenzPay Gateway for an Authorize-net Gateway.

9. On June 14, 2002, David called Bring it Home and asked about canceling his Website hosting and asked whether or not he was locked into any long-term contracts for his Website hosting. David was informed that there were no long-term contracts and that he would need to call Pacific WebWorks to confirm his cancellation.

10. On June 14, 2002, David called and asked to speak with an ePenzio salesperson. David requested information about obtaining hardware Credit Card Processing equipment to accompany his PenzPay Internet Payment Gateway. A new application package was prepared and sent to David via FedEx.

11. On June 17, 2002, David called and requested that ePenzio replace his PenzPay Gateway with an Authorize-net Gateway. This was done for David at NO cost, even though the cost to ePenzio was over $300.

Based on this information, I see no reason why ePenzio should be compelled to cancel the contracts for David. I feel that Bring it Home and ePenzio have lived up to all of the terms of the contracts that David signed on April 29, 2002. Bring it Home stands ready, willing and able to assist David with his $99 Website Package at any time. Bring it Home would also be willing to exchange Davids Virtual Web Tools Website with a new Flash Secret Website. ePenzio has delivered to David exactly what he contracted for, a PenzPay Real-Time Internet Payment Gateway system. If David has any information to show that ePenzio did NOT fulfill the terms of the contracts that he signed on April 25, 2002, I would welcome him to fax this information to me at (801) 365-2135 and I will be happy to review it.

Based on the above information, I am confused about the following items that David mentioned in his complaint:

1. Davids claim: After several calls, I found out that different little hidden charges were (where) coming out.
a. Response: The monthly charges that I believe David is referring to are as follows:

i. A monthly $10 statement fee

ii. A monthly $15 minimum discount fee

iii. A Monthly $10 Gateway Access fee

ALL of these fees are disclosed VERY clearly in the middle of the main Merchant Application that David signed and was given a copy of. This section has a heading of, Schedule of charges. Theses are also very standard fees for any Merchant Account.

2. Davids claim: It is now December and I still dont have a live Merchant Account.

a. Response: The PenzPay packet was delivered to David on May 21, 2002. His payment Gateway was changed to Authorize-net on Jun 20, 2002 (at no cost to David). The ePenzio representative personally walked David through the login process to his Merchant Account on June 13, 2002. How could David claim that he never had a live Merchant Account.

Fortunately, if David has determined that he no longer wishes to develop his Website and use his Internet Payment Gateway, there are several things that David can do to lessen or eliminate his costs. He can call Bridgeview Bank at 1-877-877-8164 and cancel the monthly service for his Merchant Account and call ePenzio at 1-800-494-1563 and cancel his gateway access to his Auhtorize-net Payment Gateway. This will eliminate all of his monthly costs except for his financing package payment for his Authorize-net transaction system. I do however, have a system in place to help David sell his PenzPay transaction system and thereby eliminate his monthly financing package payment.

This actually costs me quite a bit of money, but I am willing to do this because I really do not want to have anyone stuck with equipment that they are not using. David needs to be pro-active and find one or more companies that need an Internet based PenzPay or Authorize-net transaction system and then send ePenzio these qualified leads. Please send these referrals to my personal attention so I can make sure they get handled properly.

My email is bcrawford@epenzio.com and my fax is (801) 365-1010, attention Brad Crawford. I will have our salespeople call Davids referrals and try to close the sale for him..

Sincerely,

Janet

#8Consumer Suggestion

Mon, January 13, 2003

Hi David!
My name is Janet and my story is similar to yours as I've been ripped off by ePenzio plus their affiliated companies. I went to a National Grants Conference here in Greenville on April 27, 2002. Able to cancel out all of the other scammers except for Monterey Financial Services. Need to hear from you as to what you personally are doing about them. Please post here what is going on. Really would like to hear from you and thanks!
