Complaint Review: Movie Facts

We operate a small retail business. We were solicited by phone (cold-call) for advertising by Movie Facts. They claimed they could present an ad of our business in their ¼ annual movie guide they place at local theaters. I agreed to a 3-month deal and sent them artwork and a coupon to run. During this 3 month period the ad was supposedly active (I never actually verified the existence of the guide in the theaters) I received numerous phone calls wanting us to advertise again. I simply told them we were going to wait to see if we get some results from the ad we already did and it was likely we were not going to advertise any further if we do not see some results. Now after the 3mo has past, we received a bill for an additional 3mo. along with the bill was our old ad with an expired coupon they had apparently published again. When I called to ask them what they were trying to pull, they claimed it was my responsibility to call them and cancel the ad, and they have a recording of me stating I will do so. When I tried to explain we have spoken various times in the past they claim I needed to call them personally. They claim that was the agreement I made and they have a recording that says so. I told them if that was the case I was scammed into it and didn’t appreciate their tactics. And since they ran an ad with an expired coupon I didn’t tell them to run we are not paying for it. Now I have received harassing phone calls from accounting claiming they will take whatever means necessary to claim their debt.

As a matter of principle, I am now taking legal action against Movie Facts for breach of a contract case, as well as fraud and deceptive trade practices.
