I purchased this software, hoping for better connection, service, and support than those FREE programs out there, (bearshare, Kazaa, etc.).

I paid the $34+ fee for UNLIMITED downloads of music and movies. About a week later, I wanted to download a movie, "OVER THE HEDGE" for my 3 yr. old daughter. Now, it is my understanding, as a paid customer, that if i am going to pay for a service, when i can get it for free, i would expect more security, more support from these people since they are getting paid, right? WRONG!

I downloaded the movie, it was descent bandwidth. Only to open this file up and see something i could of been sent to prison for. For the split second i had it open, all i saw was a few "UNDERAGE KIDS" without clothes and were performing ADULT acts. you have no idea how fast i cut the power to my Hard Drive. Disconnected all my cables to my broadband modem, and started to wipe my hard drive clean.

i wasn't about to get a prison sentence over something i despise. I was half tempted to travel to this software's headquarters and show them my newly purchased Shotgun. that incident severely P*#@ed me off.

I was immediately sending e-mails asking for my refund, only to get "auto-generated" responses, left and right. To this day, I still haven't received a "legit" response from an actual customer service rep.

Why respond?

I responded to this complaint because we want to provide the best service possible to our customers, and I also care about the reputation of our company.

With regard to a refund, I will GLADLY issue a refund in full, if you made a purchase with MP3 Rocket. Otherwise I am afraid you would need to deal with the company that you made the purchase with. Now, if your purchase was through one of our authorized resellers, we may be able to help - send me an email to kvelasquez@mp3rocketsupport.com with as much information as you can and I will attempt to contact the reseller to track down and refund your transaction. Such information would include full name and email address used during registration, date of purchase, method of payment (debit, credit card, etc.), and last 4 digits of the card used (only the last 4).

Now to address the issue of the content - I will speak with our development team requesting they research the issue, and if we can identify the host (user) on the network that is uploading these files, we will advise the local authorities.

As you can see, I very well could have ignored your issue, but the fact that I am trying to work with you to resolve the complaint should show some good faith on our part.

We are taking this issue very seriously and will do whatever we can to prevent this from happening again in the future.

I HAVE TRIED TO RESOLVE ISSUE, NO RESPONSES TO E-MAILS

BELIEVE ME, I HAVE SENT 5 TO 10 E-MAILS A WEEK SINCE THE INCIDENT, AND I ONLY RECEIVED "AUTO-MATED RESPONSES" BACK TELLING THEY HAVE RECEIVED MY LETTER AND WILL RESPOND SHORTLY.

I DON'T EXACTLY WANT TO SAY I AM SORRY FOR ANY ACCUSATIONS, BUT ONE ONLY WOULD ONLY WONDER WHAT WOULD HAVE HAPPENED IF FOR SOME STRANGE REASON THE "INTERNET POLICE" OR SOMETHING HAPPEN TO STUMBLE UPON MY ACTIVITY, OR I NEVER EVEN CHECKED OUT THAT VIDEO AFTER I DOWNLOADED IT AND MY WIFE OR A FAMILY OR FRIEND HAPPEN TO SEE IT WHILE I WAS AWAY.

WHAT IN GODS NAME DO YOU THINK I WOULD HAVE COME HOME TO BESIDES A DIVORCE OR A KNIFE TO MY THROAT? I CAN ALMOST BELIEVE THAT THE SAME SO CALLED "MOVIE" IS STILL FLOATING AROUND OUT THERE. IT WAS "OVER THE HEDGE".

I DON'T REMEMBER THE EXACT SERVER, NAME, OR ANY OTHER INFO. I JUST WANT TO LET OTHERS KNOW BEFORE THEY ATTEMPT TO DOWNLOAD OR ANYTHING. I KNOW I TRIED TO GET MY MONEY BACK AT THAT POINT IN TIME, BUT ALL I REALLY WANTED WAS SOME KIND OF LEGAL ACTION TO TAKE PLACE AGAINST WHOEVER IS CREATING THIS CRAP.

EVEN IF SOMEONE IS DISTRIBUTING IT AROUND, THEY SHOULD BE DEALT WITH AT A FEDERAL LEVEL. YOU CAN'T TELL ME IF A CREDIT CARD TRANSACTION CAN BE COMPUTED OR TRACED IN A SPLIT SECOND, THERE ISN'T ANY POSSIBILITY TO MONITOR AND OR CONTROL THESE SITUATIONS.

I DON'T BELIEVE THE STATEMENT THAT YOU HAVE NO CONTROL. $35 PER PERSON WHO GETS THIS SOFTWARE, TIMES HOWEVER MANY USERS YOU HAVE, MILLIONS? I THINK SOMEONE IS VERY HAPPY IN SOME MANSION OVER SEAS. AND THAT WHAT MAKES ME VERY, VERY UPSET. I GUESS I CAN UNDERSTAND WHY PEOPLE CLIMB CLOCK TOWERS OR DRILL HOLES IN THE TRUNK OF THIER CARS.

Kali-why even respond?

If I were Joseph, I would be even more upset at the company after your (lack of) response. Offer some type of solution- refund, few months free, contact info so he can actually talk/email with a live person. SOMETHING.

I would NOT give my money to a company that is so lax on such a serious issue. I would demand a refund and cancel ASAP.

This is typical company CYA. Blame the problem on someone else. From your post you obviously knew that this is a problem. So what are you doing to fix it? My guess is nothing.

How about offering the person a FULL refund along with your apology? That is what a REAL company would do!

NO CONTROL, OK.

I CAN UNDERSTAND IF THIS SOFTWARE WAS FREE, THAT YOU WOULD HAVE NO CONTROL. BUT IF YOU ARE GOING TO CHARGE FOR THIS SOFTWARE, TO WHICH WE ALL KNOW ITS JUST AS SIMMILAR TO KAZAA, BEARSHARE, ETC. AND THEY ARE FREE, YOU WOULD HAVE SOME KIND OF MONITORED OR RESTRICTED LIMITATIONS TO CERTAIN CONTENT. IF YOUR GONNA PAY FOR A MEMBERSHIP TO A HEALTH CLUB, AND IF YOU SEE A DRUG DEAL, OR A CHILD PORNOGRAPHY STING OPERATION IN A BATHROOM, OR WHATEVER, YOU CAN'T TELL ME THAT IF SOMEONE COMPLAINS ABOUT IT, THE OWNERS ARE NOT GOING TO SAY, "WELL, WE HAVE NO CONTROL OVER THAT."

MY RESPONSE WOULD BE, "THEN WHAT THE H=|| ARE YOU USING THE MONEY FOR THAT I AM PAYING YOU?" THATS NOT AN ADEQUATE EXCUSE. 'THERE IS CONTROL' OVER THIS BULL NONSCENSE. I WILL GARUANTEE YOU THIS, IF I SHALL EVER DOWNLOAD ANOTHER 'MOVIE' OR 'CARTOON' AGAIN, AND ITS NOT WHAT IT WAS SUPPOSED TO, AND I GET A KNOCK ON MY DOOR FROM THE F.B.I OR POLICE, I WILL ABSOLUTELY PROMISE YOU A LAWSUIT AND/OR A PERSONAL VISIT TO YOUR HEADQUARTERS WITH A PLAIN WHITE LONG BOX UNDER MY ARMS.

I DON'T AGREE WITH YOUR ANSWER. Y-O-U CHARGE A FEE TO USE YOUR SOFTWARE, WHICH IN TURN CAN BE RECEIVED ELSEWHERE FOR FREE, BUT YOU ARE GOING TO STATE THAT THERE IS NO CONTROL? COME ON.

MP3 Rocket does not control content on distributed network

#10UPDATE Employee

Sat, December 29, 2007

Hello Joseph, this is Kali Velasquez, Senior Customer Service Specialist with MP3 Rocket. This is the first time we have seen this complaint, so we apologize that we have not had the opportunity to address it earlier.

Firstly, let me say that we are very sorry that you have had such an unfortunate incident with our software. Having said this, you must understand that our software connects to a distributed system of computers around the world, via the Gnutella network. Each of these computers are owned/hosted by other Gnutella users, not MP3 Rocket, or My Music Inc. (by the way, we have no affiliation with My Music Inc - they are simply a reseller of our software). So, if you have any issues with the files you are downloading, it is with other users on the network, not MP3 Rocket.

You have made some very serious accusations against our company (and My Music Inc as well, however we will let them speak on their own behalf) - accusations which cannot be fairly justified.

Nonetheless, we do apologize for the bad experience you've had.
