All phone numbers are not valid for MT Merrill. The realtor no longer works with MT Merrill. So who is held accountable ???? Where do we go from here?

We have been in our home for 7 months. After our first winter we noticed all cement work has shifted away from the house and some has sunk by several inches. The soil on the lot was not packed down prior to building on it.Our front steps will break off before summer. Will it all continue to sink and shift?

What will happen to our home? The structure itself, Foundation, etc? We have a roof that should last 25 yrs. We may not have a house under us but we will have a roof over our heads.

Also taking a closer look at the decorative brick on our home. It was not cemented in properly. Some places showing chicken wire and tar paper between the bricks.Won't water damage the wall under it?

This was a model home so we also have sign posts in our front lawn. We were promised they would be removed. They came by while we were at work and sawed them off leaving 8 inches above the ground. Mind you they are sunk into a better cement.

MT Merrill constructions mission statement in the brochures start out with. We take great pride blah blah blah. Then it goes on they are committed to helping families invest thier hard earned money in a new home that will help establish or strenghten a firm foundation for thier financial future. Odd how they used that statement, Firm foundation??

I know who probably did your cement work, mine was done by none other than Mike's brother, Chris Merrill - I have asked him to come out and redo mine, but he says that it is his brothers problem, because Mike and his forman should have covered it after it was poored... all I get is the run around. Chris says that he was never paid for his work, so there is nothing that he is able or willing to do. I have also tried to find out if Chris is liencesed (sw) with the state to do cement work, but can't find anything telling me yes or no.

I do have a current phone number for Mike (801)897-3711, but good luck getting him, you can leave a message, but the chances of him returning your call are very slim, unless you give him a number that no one will be at late at night, and he might leave a message (he has returned phones calls and left messages twice before, but nothing has ever come of the messages ... just empty promises).

5-17-2004. Recently I did find out that MT Merrill went out of business. Now it all makes sense why we always received the same response to all the questions we asked the Affiliated realty group representative. The poor guy ( Robert Brinkerhoff) was probably not told everything by Brad Morgan, his boss. I will look into that, I will check on that, I will get back to you, etc. Brad never gave him any answers to be able to answer our questions. They were well aware of the situation MT. Merrill was in. Now I would just like to know who did the cement work for MT Merrill. Any answers out there for me ??? Thanks. Any Help would be appreciated.
