Music123.com Bait/switch, failed to deliver guitar as ordered off Ebay, Internet

I used "buy it now" to purchase a slightly damaged guitar from Music123.com. They emailed me a backorder notice...expected delivery for 30 days out.  I wondered how this can be for a specifically photographed guitar, with the specified damage plainly seen.  Why would a unique item like this be backordered?? I called them, and they had a record of one such guitar being processed.  I waited two more days for another shipping notification to no avail.  The phone rep was very vague about it...said they get these damaged guitars from time to time.  So, just WHAT guitar did I buy?  Something else that was damaged much worse?  The Ebay listing did NOT specify that it would be a similar or like-damaged instrument...but it was THIS EXACT item to be sent.  

I have heard nothing back from them, and my paypal charge is still shown on my bank statement.  The order communication is as follows:

I'm tired of screwing around with this. You accepted my Paypal payment from the Ebay "buy it now" auction, then did not have the product to send to me. That is FRAUD. 

REFUND MY MONEY IMMEDIATELY!!!

Music123 called me today, and  refunded my purchase price.  

I will not do business with them again, but I am glad it is over.  Thank you to moderators of this site for providing this venue.

Ebay item number

The Ebay item number is 200702067993.  Nowhere in the listing do I see it mentioned that the auction winner would receive a like item, or something not yet in stock, to be sent at a later date.  I had every expectation this would be the EXACT item pictured, that I paid for.

Because based on your comments and the update from the business it sounds like they may be posting AGAINST EBay policy.  They generally do not allow a seller to sell an item that is not currently available unless they meet certain conditions for a "Presale".

You can view their presale policy by going to the link below.  If this site happens to redact it just search for "ebay presale policy"

If they did not state it was a "Presale Item" they may have violated the Ebay policy and I would forward the Item Number as well as the e-mails you received(and this RoR) to Ebay for possible action against this seller if they did in fact violate policy.

Out of curriosity can you provide the EBay Item number?

The Ebay auction did NOT in any way, specify the auction was for a lightly used or damaged guitar that may or may not be available.  It was for a SPECIFIC INSTRUMENT with pictures of it.  You did NOT have this item as pictured.  I paid for it, and you did not ship it.  Bait and switch.  REFUND my money NOW.

My Name is Chris, I work for Music123.com. We use ebay to liquidate lightly-used returned product that we cannot sell as new. Sometimes we get more orders for a listing than what we can fulfill. We always cancel orders that we are unable to fulfill and notify the customer immediately by e-mail. I apologize if there was any lack of communication in this manner.
