I was "auto-enrolled" in a "home improvement discount club" and automatically charged $139.95 on 12/17/2002. This charge was posted directly to my bank account without my authorization.

I discovered this charge on 02/07/03 while auditing my bank statement, and immediately called the company identified on the charge, "MWI Homeworks Plus." The automated machine prompted me to enter my telephone number and after a lengthy wait, Tiffany (ID#9997)answered my call.

Tiffany asked for my billing address and then asked what the call was in reference to. I told her that I had not authorized this charge, and requested a refund for $139.95. She said that she would "cancel my membership immediately" and that the credit would appear on my bank statement.

On 3/24/03 I audited my February bank statement and found that no credit was posted. Once again, I contacted MWI, this time speaking with Ashley (ID #9705). Ashley informed me that HER records indicated that my account was credited $95.00 on 2/10. When I told her that I had the bank statement in front of me and that I had received no such credit, she told me that I would need to take this up with my bank.

I told the woman that the charge was unathorized, and asked for a refund in the full amount of $139.95, and she said that she could not give me a refund because her records indicated that I had already received a partial refund. I asked her how MWI got my account information, and she said that "we received your information when our program was introduced during an infomercial."

I then asked her if her (obviously scripted) statement meant that computer software had automatically obtained my account information and drafted it without my approval. She replied "Sir, I cannot confirm or deny that. All I can say is that our billing is done electronically." I then asked for the name of the infomercial company that gave out the information, and she said "No one has that information." I said "surely SOMEONE at your company has it." Ashley said "Sir no one can give you that information. All I can say is that our program was introduced during an infomerical.

After I pressed on for the call center manager's name, Ashley told me "Diane" but would not confirm if this was a supervisor, or the manager of the entire center.

MWI Homeworks Plus continues to refuse to refund me the $139.95 that they took from me wihout my authorization.
