Complaint Review: My State Processing

My State Processing David Young Rip Off For Loan Modification Las Vegas , Nevada

We have been trying to do a loan modification on a rental property we own for the last year.  We tried on our own and were denied twice.  At that time (October 2011), we were contact by David Young of myStateProcessing.  We agreed to work with him as a third party processor to attempt yet another try of the loan modification, explaining to him the situation.  He said he contacted our loan company and was able to get us pre approved for a modification with a much better interest rate.

Exact Email:  After speaking with Lynn from XXX today, below is what we currently have you pre-approved for at this point in time. Since this is not your primary residence the home does not qualify for any Govt programs only In-House. We will need to submit updated documentation to them as they will need to verify employment, rental income, tax returns etc.

At that point, he requested half the payment of $1000, which we sent a check for.  We provided to him all the documents requested when asked.  About a month later, I received a letter from the mortgage company denying us for a modification.  When I called them, they said that a pre approval was never given to David Young.  When I called and confronted David Young, he gave me different excuses.  He told me to let him call them, which I did.  Throughout this process, my loan company would leave me messages and I would call them back, and they were verifying information, still not knowing of an appeal from the first attempt.  When I asked David about this, he told me that I was paying his company to contact the loan company and to just let him know when they call.  The email/contact is very limited now.  Before he got my money, he was constantly contacting me giving me 'updates.'  I had requested my money back by the 31st if he was unable to get this loan mod preapproved.  I contacted him yesterday and today and have not heard back.  It does state in my contract with his company that if he cannot get the loan mod approved, that he refund the full amount we paid his company.  But after just reading other reports, I'm worried this is a scam and really cannot afford to lose this money.  Obvously if people are desperate enough to try to work to get a loan modification and paying a company for help, it's money that they do NOT have to lose.  I will contact a lawyer if he does not refund my money.

This is great that your refund was returned. Based off all the consumers that David affected, your refund was probably funds from others he ripped off to buy himself more time. We too received a partial refund before he disappeared. I'm glad we got $1000 of our $3000 back but some other unsuspected sole probably was taken and that's how we got a portion back. There are probably more than a dozen people he has conned . We are still trying to recoverfrom what he did to my family and I hope karma gets him and hits him and his family as hard as we have been hit.

Sorry Shar...I have no contact for this guy. Once he was found out and made of with our $2000, The last word from him was in January 2012. His website listed was "Under Construction" this is when I knew we would not hear from him. He shut off his cell and business numbers. The only people who has some kind of contact with him is the Nevada State Attorney General Office. If you have not filed with them I suggest that you do. There's a contact number there if you need to get any additional information on him. I also left a message with News 13 and gave them the details, so they can contact you if needed. Sorry again for your inconvenience. The only other address I have for him is:

9461 Bluff Ledge Ave

Las Vegas, NV 89149

(917) 767-2426

This address I searched and found they foreclosed on this property and the bank owns it. The number has been disconnected. Hope this helps.

Third Party Processors for modifications of mortgages

#9Consumer Comment

Thu, March 15, 2012

What a shame that companies such as the one mentioned in this report continue to prey upon consumers who unfortunately are duped into believing any company can successfully work with a mortgage lender and get their mortgage modified. Trust me there are millions of consumers who out of desperation see advertisements for these third party companies and truly believe they can help them save their homes. SHAME ON ALL OF THEM. I don't know how the owners and everyone associated with these companies who claim they will work with your mortgage lender to negotiate a modification can sleep at night. There is a fair amount of the population who is clueless about their mortgage and I used to be one of them until I found myself fighting with my own mortgage lender. I've got 3 laptop bags full of correspondence dating back to 2004 when my problems started.  Sadly there are millions of consumers who do not know where to turn to and every single company in the mortgage business by law , is required to provide their customers who are in danger of defaulting the contact information for help which is usually the US Department of Housing, better known as HUD for a starting point to get assistance. Unfortunately it is time consuming and NOT A GUARANTEE, that every consumer will be able to keep their home or find the help specific to their individual circumstances. Bottom line boils down to who your MORTGAGE LENDER is especially when looking at programs such as  MAKING HOMES AFFORDABLE PROGRAM OR OTHER GOVERNMENT PROGRAMS instituted during the housing crisis. In a nutshell BE FOREWARNED, IF IT SOUNDS TO GOOD TO BE TRUE, THEN IT IS when dealing with Third Party Companies successfully negotiating a mortgage modification on behalf of a consumer. Any modifications that are successful are FEW AND FAR BETWEEN as well as draining customer finances that are already precarious at best.

David Young Made Good on Promise

#9Author of original report

Wed, February 08, 2012

Update:  David Young advised that he would do a wire transfer into my bank account on 2/3 for the due refunded amount, and that it would hit my account on 2/8.  I have confirmed that the transfer of funds was put into my account this morning.  I am unable to remove the negative posting, but did want to let consumers know he made good on his word.

MYSTATEPROCESSING RESPONSE

#9REBUTTAL Owner of company

Wed, January 25, 2012

This is a response to the recent posting of this customer. Mystateprocessing has done everything possible for this customer to get a modification completed and once again it was a decision that was left for the bank to make not mystateprocessing. We have properly submitted all documents to their lender in a timely manner along with providing updates as frequently as possible. It is not our companies fault if the bank declines the modification request. All customers that were and are due refunds have received them. As it states above the refund agreement is not due until January 31st 2012 so there is a negative comment made prior to allowing the company to issue the refund on the date that was specifically given by the customer not mystateprocessing. I hope that once these customers due receive their refund as promised will also let everyone know that mystateprocessing lived up to their obligations.
