National Cellular Owner Association They offered cell phone insurance and didnt cover the phone when it was lost Internet

I had purchased cell phone insurance on a phone i bought thru wirefly.com from NCOA. In the small box it should the plan for the insurance stating that it was 49.99 for the year with no deductible. So i clicked on it and purchased it as part of my deal with wirefly.com

On October 5, 2008 i had lost my and went to the police station and reported my phone lost. the next morning i called ncoa and left a message asking them to call me cause i had lost my phone and wanted to report it to them. I never got the phone call so i went online and tried reaching them that way and i fax them my police report aswell.

When they had emailed me back thy stated that i would not be able to recieve a new phone cause they said the reason i lost my phone was because of negligence. I then faxed them and told them that this is not right especially when it was a mistake and i followed there protocol.

I am very unhappy and want to appeal this decision. Please let me know who i contact and where. I need this matter resolved. This is the reply i recieved from them.

We recieved your fax. Sorry, however the natyre of your "loss" precluded reimbursement in accordance with the Terms & Conditions of coverage as posted online by both NCOA and your cellular retailer. Would u prefer to cancel the NCOA and recieve a member fee refund? Please advice.

What bothers me is that on wirefly.com when they offer you this insurance it doesnt state anything about how if you lose your phone it could be because of negligence. If that was the case i would of not gotten there insurance and gotten it thru my wireless carrier.

Now they left me without my phone and i would have to pay full price for it if i wanted to have the phone again. So them offering me my money back doesnt do anything for me cause i would still be spending alot more then that to purchase a new phone again.
