This letter is to follow up on our conversation of March 14, 2016, regarding issues of mistreatment, unjustified continuous change requirements and mandates required by the city's building official Luis Sainz. I am dissatisfied with the level of service and professionalism Mr. Sainz has expressed time and time again. I have already tried to resolve the issues by complying with all requirements and corrections given to me by Mr. Sainz and Robert Hernandez.  I have enclosed a copy of the letter approved and signed by Mr. Hernandez in collaboration with Mr. Sainz listing all requirements needed to FINALLY  be given a TEMORARY OCUPANCY CERTIFIACATE, as per request, two wet copies were given to the city Attorney as well. After complying with such mandates, Mr. Sainz has not only verbally made me aware of his malice intent, his argument hold no lawful grounds to ANY building code or law, to hold my permit hostage.  I have enclosed copies of all documentation proving Mr. Sainz reason are solely biased on malice intent, abuse of  power, and in violation of the code of Ethics with ICC, IAS and The Ethics Commission. As a civil servant to the people and businesses of National City, he is clearly in violation.

Unfortunately, the problem remains unsolved. I am herby requesting that you:

1.) Issue the Temporary Certificate of Occupancy as promised in writing

2.) Relive Building Official, Luis Sianz from his active duties on the basis on negligence, bias, and unethical treatment towards others and myself, until further investigation is concluded. [i.e., expect formal complaint letters from 6 other victims, in the following days].

3.)  Monetary Compensation for monies lost, loss of business, including and limited to, reimbursement for plan resubmit  cost, reimbursement for redo of prior approved ADA parking location, and excess and emotional, physical and mental stress.

Please contact me within 5 days to confirm that you will honor or reject my request. I have prepared for submittal Formal complaints with the proper agencies, such as Ethics Commission,  California Consumer Affairs, and International Accreditation Service (ias). I will not file the complaints nor seek legal action against the City of National City if you resolve the problem within this time period I have indicated.

I am having a similar problem with the Luis Sainz. My construction has been delayed for 6 years.   I would like to know if your problem has been resolved and how?  I have approved plans, but the city keeps making me alter the plans, or finding more problems at a great cost to me. This is costing me a fortune because my house had to be empty for the entire time.  I am possibly in need of legal councel, I feel that the city, and specifically Luis Sainz are abusing their power.   If you are like me and still having problems, maybe we can all get together and start a class action lawsuit.
