Complaint Review: National Expo Group - Kristen Martin

On October 31, 2006 I entered into a contract to work as an employee for National Expo Group. I was hired as a Regional Sales Manager I have a contract dated October 30,2006 stating that my salary was $75,000 per year. I filled out and sent in my W-4 form. I was required to submit a time sheet containing the hours I worked during the pay period on November 20,2006 and that pay period was to be paid on November 25, 2006. My timesheet was from 11/3/06 11/17/06 11 working days, which would be $3437.50. I was not paid on that date. Kristen stated that there was a problem with ADP the payroll processor, so she went to her bank and wire transferred to my bank account $1000.00 on November 28,2006. Then on December 1, 2006 a Direct Deposit through ADP for $750.00 minus taxes for a net amount of $660.58 was deposited into my bank account. That was a shortfall of gross salary still due of $1687.50 from that pay period. I received an an email dated and received on November 29, 2006 stating that due to ADP there was a delay because ADP was unable to process payroll outside of California until ADP received confirmation on state licenses where I reside. On November 30, 2006 I submitted my 2nd time sheet per my contract for 11/20/06 11/30/06. This was for 8 working days plus Thanksgiving. I was due to be paid $2500.00 for those days I worked per contract on December 5, 2006. No payment or direct deposit was made. As of today January 6, 2007, I have not yet received the full compensation due to me per my contract, in the total amount of $4187.50.

ON January 3, 2007 I spoke to Kristen Martin and she has indicated that as of December 1, 2006 she has filed for business bankruptcy - however we can find no record of any filing. She has been asked to provide attorney name and number and docket number and chapter of bankruptcy she is filing, but she has not provided me or any other employee this information.

Also on January 3, 2007 she advised me that she was sending me a paycheck for $1600.00 processed through Paychex and it would be delivered overnight via UPS. Only 1 employee received that paycheck - I did not.
Since there is no filing of bankruptcy and we are all still employees of the company my total salary due to me as of December 31, 2006 is $ 10,437.50 - which I have submitted time sheets accordingly.
