We had purchased an Isuzu engine from these guys on sept 13th sold as is with no warranty. We gave them all the information to match this up correctly (S/N, HP, YR). We received the engine around sept 17 and saw that it was Non Electronic and that it would not work. I then called National Petroleum to tell them that we had to return the motor. Jose told me they do not accept returns. There is nothing on their invoice stating they dont take returns, nor was anything mentioned at time of purchase. Ive never ran into a company that does not accept returns at all, especially when it was an error on their part. Ive filed a complaint with BBB and the Florida Attorney Generals office.


These were faxed down to them along with a note stating that the engine was going to be returned to them sept 30 and that if we did not receive a response back, we would escalate matters further. Ive had no response and they refused the engine when the freight company tried to deliver it yesterday. It now sits with YRC and we will be charged every day that its there. So not only are we out the money on the engine, but we are out on the initial freight, the freight to return it and being charged every day that it sits with YRC. Ive had no response to any complaints nor will they return my calls.


I would use EXTREME caution when dealing with this company. My advise would be to NOT to deal with them at all. If we as a business can get screwed over, then I would hate to imagine what a customer would be going through losing X amount of dollars + freight costs and being stuck with an engine they cant use. This company is a joke if they think they can get away with not accepting returns and making the mistake in the first place by selling the wrong engine!

Was the engine something besides a 6HK1XN?

    If the engine wasn't a 6HK1XN, as noted on the invoice, I can see where the OP would have a complaint.   If they got a 2002 6HK1XN engine and they just realized that it's not going to work for their application, that's too bad. 

    The OP's notion that something that is clearly sold "as is, no warranty" should be returnable is rather silly, unless it was not the engine that was listed on the invoice.

I didn't even see the part about this being sold to RJ Performance.

Poor you, and poor end customer. RJ Performance screws another person!

... Yes, RJ performance bought an engine from us. That much is true!. The engine was advertised on the engine diesel trader's web page as per the engine specifications, it was also described on our invoice and sold "as is" with "no warranty"... RJ performance requested a copy of the invoice prior to them funding us which was emailed and received by them. We did not make any false statements or provided any incorrect information like they are trying to make it sound., we did not match anything for them simply because we did not know what the engine was going to be used for. RJ performance's only concern was that we would not contact their customer because they did not want them to know where they got the engine from. We have already answered their complaint to the BBB and also requested the bureau to provide us with a written response as we will be using it along with all the already gathered information to proceed legally against RJ performance in the courts of law as provided under the penalties of perjury.

Why would you send something to someone who tells you they won't accept it, and then try to hold them on the hook for the shipping costs?

From that angle of your story alone, I have a feeling that your case isn't as cut and dry as you're trying to make it out to be.
