This company took funds out of my account without any agreement or authorization, simply based off of an inquiry call. 

Here details of the incident.
I placed a call to National Tax Solutions wanting information.  I heard the man (Dave Walker) who answered the phone say that their services would cost $200 at which point he asked for my financial information.  I  began to provide my financial information.  However, I found out during the conversation that the cost was $3,200 and said that I could not afford their services right now. The call ended with Dave, saying that he would fax me additional information.  What he faxed me was a engagement letter with blank spaces for signatures.  I did not respond nor authorize any further services.  However my bank account was charged $800 within a few days.  

When I called this company, they said that the funds had not cleared on their side.  I said that I had proof of my bank statement showing the ACH withdrawal. Dave went as far as to tell me that I did not know much about banking and that he did.
Basically, rude behavior.

A second person just called me and said she would send me an email saying what she would do.  She said that she would watch the accounts and IF she saw the funds come in, she would issue a credit (no guarantee, despite 100% proof that funds were out of my account).  

Overall, they would not admit to their error - they kept telling me that because I provided my bank info, I automatically hired them.  WELL I DID NOT.  The transcript of the call will show that I first wanted more information before doing so and that is how the call ended.

Ms. M contacted our office on June 6, 2011. She did in fact speak with Dave Walker. He took her through a consultation to determine if we could help her with her Intent to Levy notice that she received from the IRS.  At the end of the conversation it was determined that we could in fact help Ms. M.  There was no mention of services would cost
of $200.00 because our consultations are free.  Once it is determined that we can take the case then a fee is discussed and agreed.  At this point Ms. M then provided her banking information to initiate the first payment of our fee to be processed on the 14th of June. She was also faxed out the necessary paperwork to commence contacting the appropriate tax agency (IRS and/or State Agency).

Ms. M then called back on June 17, 2011 stating that she did not authorize the payment nor did she send back the paperwork.  Our office explained that had she called earlier to cancel the scheduled payment, we would not have processed it.  She insisted on an immediate refund, stating that she did not have the funds to cover this payment.  We explained that the check by phone process takes 5-10 business days to clear our account. We assured her that IF and when the money does clear we would issue a FULL REFUND. We explained that we cannot issue a refund until we have confirmation of payment. We assured her of this verbally and via an email (see below).

Per your conversation with National Tax Solutions today, the charge has not cleared our account.  I will check every day until I see the payment clear (typically this takes 5-10 business days depending on your bank), if and when it does clear; I will issue you the refund right away. If the payment is declined for any reason, then there will be no need to issue a refund.  I will keep you informed.

 In summary, we regularly take payments over the phone. We regularly take payments over the phone, along with postdated checks. We have a full refund policy if work is not performed.  She mentioned the issue of services would cost $200.00, our fee is much greater and we would not agree to start with that amount of money.  We proceeded as she instructed by processing her payment on the 14th and mailing her out the subsequent tax package. We addressed her call in the best manor possible and agreed to refund her if in fact the check cleared. She stated that the money was not going to clear and that she had incurred fees. In her haste we attempted to comply as best as we could. Yet at the end of the day she issued a STOP PAYMENT on the check, therefore we never received any payment from Ms. M.
