In recent previous months, we have fallen a little behind in our mortgage payments to Nationstar. They, in their own right filed for foreclosure on us. After talking to a representative of the company, He and I agreed on what I needed to pay to cease the foreclosure proceedings and possible sheriff sale. With the date of the sale on the horizon, and only a few days to get the money to them, I acted promptly on the matter. Knowing the sale is on May 12, 2008 at 10:00 a.m., my representative informs me on the Friday before that he needs an additional $425 dollars to make a total of four solid payments. He tells me they do not accept partial payments and without that dollar amount, I only had three and a half.

So, Monday morning, I wired them the money. I call my representative to inform them of the wire, and he confirms it. Tells me he will type up the paperwork and will shortly fax it to me to sign and return. He also informs me the foreclosure proceedings will be stopped.

I receive a call from them a short time later and they apologize but a mistake had been made. They needed an additional $34, yes, thirty-four dollars to make whole the four payments. I say no problem, and wire the money. So, at a cost of $10 per wire transaction, I wire the $34, actually I sent $35. He explains one more time the paperwork will be faxed to me and to sign and return.

Hours go by. Keep in mind, it's Monday, less than 24 hours from the slated auction time. He calls me back after I called him several times. During one of those calls they asked me if I could come up with another $1500. At this point, they have received from me several thousand dollars in just a few weeks and I was about spent. I explain this, he replies with "no problem", let me see what I can do and get this faxed to you.

On Monday, May 11, 2008 at 4:50 p.m. I receive a call from them and it's not what I had expected... he informs me I need to wire the $1500 before ten a.m. Tuesday. I did what I could and somehow scraped together the money but it would not be in my possession until 10:00 a.m. Tuesday, which is auction time.

They call at nine a.m. and I tell him I will have the money at ten o'clock and will wire it at that time. He says that is not good enough and there is nothing he can do. I ask for a window of just ten minutes. Yes, ten minutes and he denied me that.

I immediately seek council and by 10:04 a.m. my attorney had a motion of stay typed up and filed in henry county courts. he proceeds to call all involved, i.e, Sheriff's office, attorney for lender, and the auctioneer only to find out my home was sold at 9:58 a.m. Fortunately for us, the judge did take the time to at least read the affidavits and he signed the motion to stay, which halted any further proceedings of the sale.

I am still in my home for now and hope to see the sale reversed but we just do not know what is going to happen next.

Nationstar is using illegal and very unethical tactics to give it to the homeowner. I met the original agreement and came up with an additional $1500 for them but I truly believe they never once intended to help me.
