Well...It all started about a year ago! i got a call everyday saying NCO financial...we are a debt collection agency blah blah blah...Well I Have not been in the position where anything where i would be in debt so i just clicked Ignore to the 800 numbers.

My husband and i had an Apt in VA, we got orders (we are military) to move to AZ, So we moved in November, I called and canceled all gas, electric, etc...And we moved, i continued to get these calls. Note we are now in AZ and it is 2-3 hours behind (it changed from 2 to 3 hours AZ doesn't have daylight savings) So now the people are calling at 5-6 Am in the morning...I'm pissed.

Well suddenly the calls end, we had gotten our tax return and had quite a bit of money being military and having a daughter...I noticed about a month ago this "check" written it was check number 9000, I clicked on the picture and it was an electronic check written to NCO/N1source...I immediately filed a fraud check with my bank...considering they claim my husband "electronically" signed this so called check...which he did not do. EVER.

The bank is giving me hell saying its the gas company, Which i have called and they claim they didn't start anything in that way, but our account is negative, I asked why they said because you haven't paid since November, I was like that's because we are in AZ and no longer live there the gas was supposed to be cut off...I'm dealing with this problem separately.

Well problem is-Bank doesn't want to refund the $358 the lady actually denied my claim without finding out who this check went to!!! She claims my husband said ok to it...when he didn't! I don't know what to do!  (she said it went to gas company-but gas company says it never got to them and we aren't actually in default) NCO will not answer my phone calls- sat on hold for 40 min then went to a voice mail.

I feel i'm at a loss...I have no freaking clue how they got my husbands info, My husband is military if these people are illegally getting stuff his bosses need to know, I'm not sure how this is legal? because we have NEVER spoken to them, NEVER received any letters from them, There is NOTHING on our credit report....What do i do PLEASE HELP!

You can get your money back, and you can prosecute someone too.

This is outright bank fraud, and is grand larceny, a felony.

Here is what you have to do:

1. Order copies of all three of your credit reports right away. I use a service called identityguard which is fantastic and is not only for credit reports but they provide complete financial monitoring and watch for fraud like this.

2. File a police report for the THEFT of your money.

3. File a written claim with your bank for the theft of funds. DEMAND to see the authorization they have on file for this transaction, including the origination source.

4. Cross file the complaint, in writing to the FDIC which insures the money in your bank account.

5. Send a NOTICE TO THE RECIPIENT OF YOUR MONEY that you are filing criminal charges for the theft of your money.

Send all of these notices ONLY by certified mail, return reciept requested and be sure to put the certified# on each letter and make a copy for yourself before mailing, as this proves exactly what you sent.

Once all of this is done, prepare a packet with all of these complaints and proof of mailings and turn it over to your base legal office.

You can also notify the DA in the jurisdiction of the offender and seek prosecution.

You can also file a civil suit to recover damages they have caused you.

Good luck!

I would tell the bank flat out either you refund my money or I will close my account and go to another bank. I would also report  NCO to FTC and the BBB . You also might want to talk  to a  lawyer about this as well.
