The Fair Debt Collection Practices Act or FDCPA, (15U.S.C. 1692), prohits debt collectors from engaging in Abusive behavior. I had a verbal agreement over the phone to pay $10. a month, June, July, August. The very next month NCO called me, told me they did not agree to $10. a month. Jennie said they will seize my assets, and would begin collecting a list of all my assets. We then agreed to $50.00 a month payments until Jan/Feb when I would pay off my account with my tax refund. Jennie called the next month and said we had no agreement, the entire amount was due, or make payments of $185. a month. She was very rude and abusive with me, and then hung up on me before I could get information needed to send NCO another payment. I have never received a receipt for any payments I have sent in, And no statement showing my balance. Today I have filed a complaint with the Federal Trade Commission (www.ftc/ftc/compllaint.htm),I also plan to file a complaint with my States Attorney Generals Office, and The Better Bussiness Bureau. Perhaps a Class Action Lawsuit needs to be taken out against NCO Financial, to force them to comply with FDCPA.
