NCO Financial has been given an account from National Fuel Gas Co of Buffalo to collect on a debt addressed to my father who has been dead for 9 years.

The US Post Office changed the former address of the account to reflect MY address.

My dad - Herman and my mother Joyce are both dead and NCO is trying to collect from dead people.

My mom's lawyer says that I her son am not responsible for paying her (their) bills. I was named as executor of her will and followed it to a "T" and no where are their inclusions of paying bills.

Just becuase at the time of the deaths of Thomas parents, the bill was not listed as a bill, does not mean it is not a valid charge. You just scream in yor response (and most of your posts), that IT IS NOT VALID. Obviously, Thomas has shared all the paperwork with you. As I said, Thomas is not responsible for the debts personally. However, the estate is responsible. Just like if they had a mortgage for 1 million dollars that only had fifty thousand paid. The bank gets to recoup the house. In the case of home heating oil, it can not be recouped.

Who do collection agencies think they are that they can lie about you accusing you of yelling & screaming @ them. They get you upset then blame you for getting upset. It's time this needs to be brought out how these collection agencies lie about people like how they have treated me & my mother. They have no right to lie about your or make false accucations & falsely accusing you of yelling & screaming @ them when they are the ones who provoke you to anger!.

The entire burden of proof is always on the collector. The collector must prove you are obligated to pay the debt.

NEVER send ANY documentation to any collector, and never sign anything, not even a letter you send them.

The only thing that needs to be sent here is a CEASE COMMUNICATIONS letter by certified mail, return reciept requested. be sure to put the certified # on the letter itself.

Also file FTC complaints online for each violation of the FDCPA.

NEVER speak to any third party collector. Anything you say can and will be used against you.

Excercise your right to remain silent.

Actually, being dead is not an excuse for not paying a debt. Let me explain. Normally debts would be covered by the estate of the deceased, at least if there was an estate. You personally are not responsible for the debt. When you are talking to the collector, advise them of this. Obviously, they will note this and may ask for proof. Proof in a case such as this would be a copy of the death certificate. While this may seem extreme, amazingly some people will lie to a collector. Give them a chance, and work with them.

These crackheads will still go for the default judgement. Being DEAD is no excuse!

They must have paid about 1/10th of a penny on the dollar for that one.
