For a couple of years now, I've been making payments to NCO regarding a Sears account. Here's the thing: I've had two fires, one in 1998 (mostly just smoke and water damage), one in 2001 (pretty much took everything), which made me lose all our financial records. I could almost guarantee I had paid the Sears account off, but have no proof.

Since NCO contacted me in 2005, I had been asking for a record of proof that I still owed money on this account. I finally received a listing in the mail that shows I've been making payments sporatically since 2001, but nothing about the original Sears account. I'm willing to pay it back if I do indeed still owe money, but after reading several of the other reports here, I'm extremely skeptical that I do owe money. Any suggestions as to what I do?

The damage is done already, you legally affirmed the debt

Angie,

The basic rules that you should always apply when dealing with debt collectors/junk debt buyers.

1. NEVER call, or accept a call from a debt collector. NEVER.

2. NEVER make a payment to a debt collector prior to making a debt validation request, and recieving adequate documentation.

3. Always demand proof that they own or have legal right to collect on a debt.

4. Any communications coming out of NCO is a scam.

When you made a payment on that old, most likely past SOL uncollectable account, you restarted the SOL for collections and affirmed the debt.

They can now sue you and win, where before they may not have been able to.

Immediately demand a full accounting of all charges and history of payments. Demand an accurate dollar figure of what they claim you owe.

Communicate only in writing, and by certified mail, return reciept requested. be sure to put the certified# on the letter itself and keep a copy for your records.
