Back in 1996 my boyfriend let his vehicle get repo'd after he lost his job.  Apparently it is important to mention I was a co-signer on his loan note from Ford Motor Credit company.  We got a notice (back then) that the vehicle sold at auction and we still owed about $7k.  The Ford Motor credit company wrote off the remainder and that was that, or so I thought. In February 22, 2012 my Wells Fargo bank account was seized and all of my money vanished without warning.  I checked into it and finally found out that Nelson and Kennard bought the debt from Ford Motor Credit Company and put a judgement against my account for the vehicle repo that happened in 1996,  That is a debt that happened approx 16 years ago. The money they took caused me have to quit college, I was late on my rent and other bills (utilities, food,gas) you name it I had no money for anything.  my landlord was being nice and let me try to get caught back up, but since I had no gas money i could not stay late for work anymore because I had to hitch a ride from friends which I depended on the overtime.  This situation caused me financial ruin.  As it was, I was living paycheck to paycheck...my daughter and I had to live off of whatever we had in the house. My job gave me notice that since I cannot do my job thoroughly which required I stay until the job was done for the day, they let me go 6 weeks later.  To top things off I have not been with my EX-boyfriend for over 11 years now.  These people at Nelson & Kennard never sent me any letters or notification and now they have taken not just my job, my money, my education, and my daughter, because she had to go live with my EX of all things because I was flat broke, homeless, jobless and now I'm living in my friends garage looking for a job just to try to pick up the pieces of my life that Nelson and Kennard took from me without warning.  I do not know if what they did was legal because I cannot afford an attorney let alone my next meal.  If there was a god forsaken cliff in this town I would have jumped off a month ago, but thinking of my daughter I did not do it, obviously.  I do not even live in California and I have not for years. What Nelson & Kennard has done is rob a hard working person without any regard or negotiation. Can they just file judgements without contacting people and take all of thier money? Who is the judge signing off on theses fraudulent documents?  I have to wonder if someone isn't getting paid under the table on this just to get illegal judgements signed by the court.

Just a little information for you to help clear things up. I have nothing to do with either company you posted about, but it sounds like Ford had obtained a judgment against you for the deficiency balance on the vehicle. Even if you move, the judgment holder can domesticate the judgment in your new location. Judgments last a long time. In most areas they are good for ten years and can be renewed for another ten years. The judgment is a separate public record that may or may not be on your credit report. It does not have to be on your credit for the judgment holder to collect on the judgment.

I don't know the timeline of when your funds were actually taken, but you may be able to get your funds back if its within 30 days of the funds being removed from your account. In order to do that you would have to vacate the judgement. In order to vacate the judgement you would have to show
cause as to why the judgment is not valid. Check legal aid in your area to see if you can get help with this matter.

However, the very first thing you will want to do is to see the judgment against you. Get a copy of your records from the county in which the judgment was filed. This collection against your account may be the first of many - so find out the amount of the judgment to see where you are right now. Also, the judgment accrues interest from the date it was entered so you have many years of interest. I only mention this to you so you can fix the entire issue either by vacating the judgment or getting a full Satisfaction of Judgment recorded so they can't come after your bank account again.
