A letter to the Rip off web Designer

A key point that you left out of your last statement was that the website never worked or was finished oh and
the webhosting company blue host still shows you as the primary person in charge of the account, it has never been turned over to our firm. Not one order ever successfully was placed, even the one I tried to do as a customer to the
site failed.  Your company corrupted the so called file on this site. Back in August 2010 when you had charged me for a completed website, I called and informed you that it was not complete and needed more work. I also let you know
that it wouldnt allow me to place an order. You did not listen to me, you just wanted to argue with me and tell me it was done. I have been patient with you and have continued to try and work with your firm.  Apparently, the site has been corrupted since you started.  You said to me on  February 3rd at 3:48 pm, via a phone conversation, I apologized for the mishap with your site.  You reassured me and you gave me your word that you would have this site back up online and going by Wednesday, February the  9th

It is wrong to not deliver the product which you sold to a client. I spoke with Blue host today and Im sure
you know by now, that you lost my front end when you upgraded Zen cart without backing up my theme.

If we don't have resolution by next Wednesday, the 13th of April , either by completing my site in full with a solid specified completion date or a refund in full,  I will be taking all of this and more evidence that proves the site was never
complete to my attorney. I will also consider filing a complaint of failure to render services for which payment was received  with the Better Business Bureau, the states Attorney Generals office, Oregon regulatory licensing department, and the Federal Trade Commission. You did give me your word that you would make my website work and function to my satisfaction back in February.

You really need to start being honest to yourself.  Ive talked to other clients that you have had in the past, and they have had similar complaints to the ones I have. The Vikingheating.com site has nothing to do this particular matter. I understand youre a business, you need to make money, but at whos expense? Ill rebut quickly:
 
1)
I supplied you with the original R & M Catalog, of which you
quoted me a price

2)    
Viking Heating and Mechanical has nothing to do with paradise
garden supplies.

3)    
The images for the ecommerce site were in the catalog I provided to
you plus the catalog on cd-rom.

4)    
There arent 1000 products in the catalog, there are different
model #s for the same product but you failed to specify what a product was in our initial meeting, this wasnt brought to my attention until August. Actively on the site right now, there only 352 items that are viewable.

5)    
I gave you all of the information for paypal and why would the
configuration be my responsibility?? You were supposed to build a site from top to bottom. I paid you to make this hands-off for me.

Refer to # 5this is your responsibility because shipping being set
up for the site is part of your job.

My girlfriend was in her 3rd trimester of pregnancy. She had our daughter in November. Im sure you would understand, since your pregnancy had a lot to do with why my site wasnt running, how time-consuming that may be. Plus, I hadnt anticipated the website taking 8 months (in august
at that point) to complete. You mentioned yourselfyour team put 160 hours into this sitewhich is 20- 8 hour days, is there a reason this took almost a year? At this rate you were working on my website 1 day out of every 18 days. You dont have the nerve to tell me that 12 weeks for a tutorial is unsatisfactory. I was being lenient with the amount of time that it took you to complete my site because I knew you were pregnant.  

  The only people that were in the back end were Bryce, Scott, and
your firm I have records of the IP addresses that have been logged into the
backend, plus, I have the dates they logged in,  which blue host was nice
enough to supply me. I handed you the first catalog at our first meeting. Which never only had 1000 products in it, you saw this catalog and quoted me based on what you saw, a mathematical error on your part is not a reason you should overcharge me for something you agreed with me. R + M only added 42 additional products to the second edition which came out in April of 2010, of which I paid you more money for.  If you remember you went through with the site at that time, you had one person trying to build the first site on word press and it failed. I waited almost a year for the original site to be completed.

 But this happened only after Bryce got behind the wheel! After the
original site was completed there were several typos and broken hyperlinks, it looked incredibly unprofessional. Nobody could place an order online; therefore the side was NOT complete. I assumed you were still trying to fix the site, and was appalled after you billed my credit card without my authorization which is why the contact regarding the status of the site not being finished was brought to your attention. On top of that, since this discrepancy came to order, you have miraculously been virtually unreachable for resolution. Im fed up with the lack of professionalism with your company, Im the customer.

Remember this, there is absolutely NO reason that I paid to have a website done in January of 2010 that STILL doesnt work. Not one person has been on the backend of the site other than your company, and for you to insinuate that someone else was working on the site is ethically immoral, again I have evidence only your company has been in on the backend of the site. Ill stop you dead in your tracks. Its incredibly irritating that Ive literally lost thousands in potential sales. Viking Heating (my business) is not struggling, Im trying to expand my horizons, and I paid you for your service which isnt help. This is not a charity case; I paid you for a service that you have failed to fully provide. My site should be WORKING!

Plain and simple. I will not pay for any mistakes that YOUR Company has made on behalf of my website.  Listen very closely, Ive paid you 1650.00, this is more than sufficient to have done what needed to be done. I understand that you were pregnant, and head a death in the family; you had a lot going on 2010. Unfortunately, you own and run a business, which means the clock keeps ticking no matter what happens.

I understand you have spent many hours without positive outcome, but this is not my fault. Would you sell a Barbie doll without its head? I didnt think so either. You sold me a product; you have changed all of our original agreements, I have witnesses who have been beside me every step of the way who can verify and vouch about our phone conversations. So you cant lie or change what you have said or done, Jessica. But let me close with this, I dont have a working site, Ive paid you 1650.00 for, the site that I HAD, didnt work, and only you and your employees have been in on the back end of the site. Zen cart is the product you chose to run for the site, therefore, this problem is your responsibility.

At this point, you have quit working on my site, its unfinished, and I want my money back! If this were an auto vehicle, you sold me a lemon that didnt even leave the lot.

We tried repeatedly to work with client only to be expected to work for free! This clients website was created and handed off in Aug of 2010. The project timeline was as follows;

Feb. 2010 client asked to provide images and product descriptions and pricing March 2010 client emails PDF catalogue and requests us to copy and paste March 2010 we explain to client we need images on disk request from wholesaler April 2010 we receive FTP from wholesaler that doesn't work June 2010 we receive a catologue on disk- same PDF July 2010 we finally receive an FTP that works but now client wants to ad more products at no cost because we are taking so long( refer to timeline, we can not make clients give us the necessary content. We can only send request after request with no avail;) we agree however to insert the additional products at no charge as we strive hard to satisfy! Aug 2010 we complete the site design and insertion of all products by the 24th - request review with client Sept 2010 client can't make it in to meet reschedules Oct 2010 client can't make it in again Dec 2010 client calls and states can't login to the backend Jan 2010 NetworX trouble shoots with host in clients personal account zen cart database had been compromised Jan 2010 explain to client we are not responsible for third party eccommerce programs failing, but will try and restore the database Feb 2010 NetworX successfully restores database but now front end of site needs to be reconfigured...explain to client we cannot continue to fix at no cost...client unreasonable beyond belief! March 2010 try explaining to client how a web design company can not be held liable for third party software application errors and more than willing to work out very reasonable rate to restore, however the client wanted it fixed for free??!
