NDI, Inc. hired me to work at events around the Pittsburgh, Pa area.
My job was to travel around and place child safety boxes in several locations ie: (200). Furthermore I was to attend events and collect names for free child safety kits.
A small team of reps attend public events and scour the event for parents who didnt have a child ID kit and sign them up for it. They take their name, address and phone number and tell them that they "will receive your kit(s) in 2 to 3 weeks. These kits are an awesome idea, and an agent from American Income Life delivers them to the parents. In turn also attempts to sell Life Insurance. The life insurance is not a requirement however, is an alternative for parents to protect their family in the event of a death of a family member.
This company, NDI, also claims to pay their "employees, $2 per card they have filled out at each event.
I was to be paid $500 a week which included $100 gas allowance. I was to collect 1200 slips per month. I worked for the entire month of August and was told that my first paycheck would be withheld until one year or upon termination which ever came first. I was paid for the second week August after begging the director several times. I was then paid the third week of August after having to beg once again for payment. After several emails from the Director and being very discouraged due to no direction, confusion, and nothing but promises I decided to resign my position with a formal resignation email to Peggy Martin.
Peggy Martin informed me that my pay would be on the 15th or the 30th of the month. I still to this day have not received my July 31 thru the first week of August pay of $500. I have not received my final pay of $500 for the last week that I worked. NDI owes me $1000 and will not pay me my money. I have persisted many times with many emails and phone calls to no avail. A co-worker was paid today (which took several weeks to get only $40 which she should have been paid $80). The check stated final payment?????? I have not been paid.
The director also never had any of her "employees" fill out the required documentation, ie; W4, I-9 etc...
This is very upsetting and I have no clue what to do. Should I sue?
