I posted a job on www.guru.com for a custom website that i was interested in getting back in January of 2014.

Paulo Faustino sent me a message and we began communicating, we agreed on a price for a custom site, I send Mr. Paulo the initial deposit on escrow through Paypal as per the Guru aggrement. Mr Paulo proceeded to make a "site" for me and seeing how i was naive to the web world and web design, Mr Paulo kept sending me updates and everything was in order, we kept constant communication on email and phone chat, (which should had been a redflag for me since i never spoke to him over the phone).

he later send me the finalised copy of the site and I was thrilled with the site, and i sent him the balance (50%) of the payment, he was happy as well so i thought.

a few weeks go by and he sent me a bill for maintance, which was not in the intiatial aggrement, as soon as i stated to question these fee, he held my site and all my content in ranson and was basically black mailing me to either, pay him for the maintanance (which he wanted everymonth) of he would cancel and delete the site. (which he did, for a few months) i later agreed to his terms and after consultation with other webdesigners about the custom site he produced, they adviced me that the site was a mere purchased template which cost Mr. Paulo $50.00 and there really was no basis for me to pay a "maintanance fee" for something i could do myself.

I later contacted Mr. Paulo and basically he terminated my site, and hosting and i had to redo the site all over a gain and pay the service of a more reputable webdesigner.

if you have to deal with this one man show company (modulus web design) or moduluswebdesign.com stay clear of this oil skin dealer, he will give you what you ask and then hold your site captive to his demands.

he sounds reputable and pleasant, but stay clear, his company of one is a total ripoff!!!!

Dear Mr. James Munderu,

Submitting a fake review in ripoffreport.com won't force us to withdraw the factual review we submitted dated of March  22 of March of 2015. http://www.ripoffreport.com/r/James-Munderu-/internet/James-Munderu-PhoenixFC-Oftench-James-Kibugi-Non-payment-of-8-Months-worth-of-invoices-1217477 . You can blackmail us by email all you want, it won't happen.

It is really unfortunate to see that you not only did not pay your debts, but now are resorting to lies and fake reports.

To anyone still wondering. This gentleman is taking his revenge about having been exposed on a report submitted in March of 2015

Report (James Munderu PhoenixFC Oftench James Kibugi Non payment of 8 Months worth of invoices. Internet)

Read at - http://www.ripoffreport.com/r/James-Munderu-/internet/James-Munderu-PhoenixFC-Oftench-James-Kibugi-Non-payment-of-8-Months-worth-of-invoices-1217477 .

James, I will address a few comments on your report.

You claim the maintenance fees were not included in the initial agreement. This is false, you were made aware that you had two options about the website built costs. (A) you would pay the usual fee, or (B), a website would be built within the budget your proposed but in return you would be subscribing to a maintenance plan. This plan included Hosting and Website updates (content). You opted for option B. As you said yourself, I communicate clearly. and your actions later prove you were full aware.

You were never pushed to accept this agreement, moreover, despite not paying for several months you kept taking advantage of this agreement, after the website was launched you requested several updates, you even asked us to do small projects not included in the subscription agreement that we did because I really thought you were honest and that all those excuses for having payments in delay were real. Moreover, I like to help.

Examples of tasks you had us doing for you during the months you used the maintenance agreement

  • Several updates content updates ( you even sent us the text for blogs entries because it was easier for you that just deal with the blog entry yourself. note: This is a CMS website - Joomla, which included an easy to use editor for blog entries)
  •  At one time you sent tons of photography’s, raw, and asked us to retouch them, resize them, and then to create a gallery.
  • -Several functionality was added that was out of the project initial scope (example: News ticker)

So basically while in this report you're stating you did not agree to a maintenance plan, you sure didn't complain taking advantage of the service, while making up (I know no it was lies) excuses for delaying payments.

On multiple occasions you admitted to the debts owned, even the day I informed you we would need to cease the services due to 8 Months of non paid invoice, you acknowledge the debt. This was the day I realized you were taking advantage of our good will all along, you told me you were gong to pay but asked me to send you a full backup of the website before, because you wanted to check the files. This was when I realized you were never going to pay, it was an odd request.

It´s important to say that I contacted you on multiple occasions prior of the suspension of services for non payment. Which naturally lead to a full termination and deletion of every backup of any file relate to your account.

We can substantiate our claims with our records of emails exchanged.

A couple prints of emails exchange.

This is a print of the reply James sent to Support once informed the website was scheduled for deletion. His reply "Go ahead, and delete it". ( 18 of Feb of 2015 )

Followed by a print of the first time Mr. James was informed that not paying the outstanding invoices would result in the suspension of his services. (15 of Mar of 2014 )

The report we submited against Mr. James for not paying his invoices after keeping us on a excuses roll for several months. (Link Below)

Report (James Munderu PhoenixFC Oftench James Kibugi Non payment of 8 Months worth of invoices. Internet)

A final note. It's easy for everyone to see what's really going on here. Mr. James Munderu never expected us to file a report about his actions towards us. Once faced with the report he emailed  me demanding this report to be taken down, otherwise he would attack us and hurt our reputation in the internet. As it seems, filling a fake report was his plan.

This threat came in an email dated of 19 of Aug of 2015.

A message to Mr. James -

Mr. James. if you want us to take down the report we submited, this is not the way. You can contact me and we'll try to find a solution that is fair to both parties. Please refrain from making further threats or submitting fake reports.

Regards,

Paulo

I later contacted Mr. Paulo to let me know of my decision and basically he terminated my site, and hosting  and entirely stopped communication with me, i however had to count my loses and redo the site all over again by paying the service of a more reputable webdesigner. To date i am yet to receive my files, and photos that i sent to My. Paulo.

If you have to deal with this one man show company (modulus web design) or moduluswebdesign.com stay clear of this Snake oil dealer, he will give you what you ask and then hold your site captive to his demands.
