On 9/4/2014, Scott Kale comes into my store offering me Nova Merchant Services, he said they will give me a flat rate of .85% and it won't be tiered rate. He clearly said there are no obligations & I have 90 from the day I signed to cancel otherwise there will be a 1 year contract. He said I would have to lease the equipment from them but never mentioned that it would be a 4 year lease. So I agreed to signed on with them.

A week later I received in the mail a letter from First Data Global Leasing that I am in a 4 year contract for the equipment. I called FDGL to cancel since I have not started using the service, but only to find out that it is a non-cancelable lease and that I would have to pay the full amount if I want out. FYI, it does not say anywhere on the lease agreement of it being non-cancelable when you sign, only on the terms document they send you in the mail (NEVER SIGN AN EQUIPMENT LEASE WITH ANY PROCESSOR). Unless you want to pay over $1000-2000 for a piece of equipment that costs $200-300. 

So I decided to call Nova Merchant Services to cancel, Dave Anthony told me that he can't do that and I am stuck in the lease. I told him that Scott clearly told me I can cancel within 90 days of signing and he said they do not make any type of gaurantees and I have to keep paying (this is for the equipment lease only). I tried to cancel the merchant services which is through Blue Square and they wanted a $495 ETF. So I requested a copy of the signed documents from Dave for both the lease & the merchant account, which he was happy to send over.

When I went to compare the ones I got from Dave and the originals I got from Scott, they were different. Scott left all the fees & ETF fields blank for Dave to fill in (which he did to whatever his liking). They hike up the rate from what they tell you and if you don't call around to ask then you will never know. I went on to compare the FDGL lease agreement and to my surprised, someone from Nova clearly forged my signature on the Personal Gaurantee section if the lease. I never signed that section on the documents Scott originally sent me but the one I got from Dave has a forged signature on it.

I sent them an email stating I will be pressing charges and suing Nova & everyone involved for all fees & damages by forging my signature on a legal document. At this point I am waiting for their reply. I will update this report as soon as I hear back from them on what they want to do or I will move forward with the lawsuit.

  Hey the exact same Thing has happened to us-- along with a heft $9000 buy out fee. I was hoping you could perhaps update us as to what's happened? -fraudulent signatures -contracts do not match -contract with a leasing company 60montjs no cancellation which we had never seen -needed us to sign documents and would return the next day with our authorization from the equipment company that mapped out Terms & conditions that we needed to sign. -sales rep never to be heard from again -we are paying $100-150 more Per month then with our previous -sales rep promised to buy us out of our current equipment lease which was almost paid off. We owed $1021. That never happened -contracts have three different handwritings on them. What I signed had no terms or conditions or equipment company or Pricing. But they expect me to believe that the sales rep has bubbly girl hand writing and he wrote it all -__- The list goes on so I'm just trying to see if you had a good outcome so maybe We can follow suit.
