I have been harassed for 2 years by Nuvell, because I was used as a contact person on a credit application. I am not a co-signer on this account. Nuvell calls my house day and night, early morning and late night hours.

I've told Nuvell that I don't know where the person is that they looking for. I have asked them not to call me any more. They continue to call. I requested a supervisor, and explained that I do not owe them any money and demand that they stop calling me.

The supervior promised that my information would be removed from their calling list. For about six months this worked. Then I began to recieve the calls again day and night. After speaking with another supervisor, I was told that my information was removed from one list, but not from the oringinal list. The supervisor then said they have no way to remove my number from the this oringinal list. So when the person they're looking for is a few days late with a payment I will recieve these calls.

I requested the CEO's name and I asked to speak with him. I was not given his or her name and no connection. The supervisor I spoke with said he did not think they could remove my number from this record. I told him that there has to be a way. I should not have to be harassed day and night regarding money owed to Nuvell by someone else. The same record they use to get my phone number should be the same record that shows this person address and mine are not the same.

The supervisor said he would call me back to let me know what's going to be done about this. Instead, I recieved a call from Fort Lauderdale FL. The caller said he that was from the states attorney office and needed a statement from this same person that Nuvell has been calling me about. This was left on my answering machine. I called back from a different number and told the operator that I had been referred to this attorney by a friend for a personal injury case. She said this attorny only deals with corporate and financial cases.

I now believe I won't recieve anymore calls from Nuvel, or maybe I will. I guess I start the process all over again with their counterpart in Ft. Lauderdale.

My question, is it legal to harass a contact person, and to what dgree? Can someone help me? I am not a co-signer on this account I don't owe Nuvell any money.

You do not, as a third party, relative or reference have to take daily calls form a collection agency, don't let them fool you ! You should contact the Attorney general in your state for specific collection laws but Nuvell is sued quite frequently for this type of harressment.

Per the FDCPA:
The FDCPA says a debt collector may contact someone other than the debtor, but only to learn the location of the debtor. Usually this contact can be made only once, unless the collector has reason to believe the person has new information. If you are a relative or roommate, a debt collector who contacts you repeatedly also violates your privacy.

The important thing to remember is that you have the same rights as the debtor, including the right to bring an action for any of the violations described here. Again read the FDCPA

They can remove your name and telephone number !!
