I purchased a 1500 Silverado Truck on July 20, 2008 from O'Donnell Chevrolet & Buick. After signing their contract and giving them a check for a $1,000; I was given the keys and drove off with the truck. It wasn't a day or two later that Rudy (Sales Manager) contacted me and said that he wanted more information in order to give to the bank for financing the truck. After receiving Rudy's call I assumed that I lost the truck and returned it back to O'Donnell Chevrolet & Buick.
Before leaving, Rudy explained to me that I was still responsible for the contract amount even though he (Rudy) was unable to get financing which I know is not true. Rudy, without my knowledge or permission, then proceeded to hassle my family and friends for the next two weeks in trying to get them to cosign for the truck. Rudy subsequently got financing and paid the $1,000 down payment and delivered the truck to my home.
Now, they want the reimbursement of the $1,000 down payment which I am not willing to pay. Since then, they got a judgment against me for the $1,000 down payment. The following has been a complete nightmare.

There is something missing here.
You get a call about needing more documents and the first thing you assume is that you lost the truck? Then if you gave them a check for $1000 in the beginning how could they get a judgment at a later time for $1000?
By the way even though you may not be willing to pay since they did get a judgment against you they can take other legal means to obtain the money.
