Recently, Ocwen tried to foreclose on me even though I was current on my payments. They did this by post dating the start date of the loan in the computer by two months, ie March 1, 2002 instead of May 1, 2002. As a result, they were claiming I was two months behind in November 2003 and when I refused to agree to their forebearance stipulation, they returned my next four payments and filed Lis Pendens against me on Feb. 24, 2004. They tried to get a summary Judgement against me on Jan. 20, 2005 but due to the discovery process, it became clear to the Judge that the Note said May 1, 2002 not March 1, 2002 and I had not defaulted. All this cost me $2,950 in attorney fees to prove I did not default. The Judge denied their motion for summary Judge ment but meanwhile my credit rating has been destroyed. Truly, this is the bank from hell. I have not received any apology from them and it appears they are trying to find another avenue of
attack. Truly, the Feds need to fully investigate this bank and find out if this is a policy to intentionally force people into foreclosure court so as to tap the equity in the person's property. In my case, $120,000 home, $58,000 loan outstanding. Clearly, there was a profit to be made by calling in the loan.
