I have also been a victim of Ocwen's "lost" payment/late fees scam! I was sending my mortgage payments by regular mail to their lock box in California. I routinely mail them 2 weeks prior to the due date. February, 2002 was when the first "lost" payment came up. I mailed it on 1/20/02 and they finally posted it on 2/13 -- almost a full month later! They had called to say the payment was never received, but it showed up at my bank 2 days later.

The second time came in May. I mailed my payment on 4/19/02 (due 5/1/02). The grace period for late charges ends on my account on the 13th every month. They didn't call to say the payment was not received until 5/17/02! They charged me a late charge and refuse to reverse it! I had to stop payment ($28) at my bank and send another payment.

I contacted them by phone several times and was shuffled from one person to another without anyone ever resolving anything. I finally got so frustrated, I filed a complaint with the BBB of Central Florida on 6/24/02. Today is 8/26 and I finally got a response from the BBB. They said Ocwen has refused to work through them. They usually can resolve issues of this nature, but Ocwen will not budge. Big Surprise! They referred me to an agency within the US Treasury -- the Office of Thrift Supervision. I am drafting a letter today to send to them also.

Ocwen still refuses to remove the erroneous late charge even after I sent them a copy of the Stop Payment Receipt from my Bank and the fact that I never had a late payment before they assumed my loan from Republic Bank!

You can bet I will be doing everything I can to get my name on the class action suit!
