After my divorce in 1992,I was left with one third of the income. I got in trouble with my Mortgage and turned to HUD to save my house. We set up a Mortgage Forbearance based on my income. Almost two years later they send me a statment saying that I have an interest Arreage of $11,000.00 plus.(They charged me interest on the interest!) It was never explained to me that the interest would continue to grow.
after reviewing my records and reciepts,I found two or three late charges that I was charged for twice.

In March 94 I recieve the letter explaining the sell of my mortgage to Ocwen. After the first couple of months,I was making payments of at least $100.00 over my original note and mortgage. A lot of this was being put into the Escrow Account.

I had no idea that they were susposed to refund overage in the escrow account over a certain ammount. For about 5 years I had overage in my account with no refund. Once I even asked them to make my monthly payment out of the $1,289.00 they had in my account after taxes were paid. They said they could not do that and could not send it to me,because of the interest arreage.

They collected all the interest on my Escrow account for about five years. Finally then, they deducted the amount of one payment from the interest arreage.

After the first six months of Ocwen's purchase of my loan, they began to hold my payments for 5 to 10 days before putting them on the books. They tallied up these false late charges.($123.00) I began certifing my payment from that time on. It is sad that they are so low and dishonest. Now,since I have been certifing the payments or calling in check by phone I found three signed certification reciets that are dated before the 15th when the payments are actually late according to my Original Note and Mortage that they put down and charged me late charges for.

I pay many bills check by phone from different creditors. Most of them charge nothing. Ocwen charges $5 & $10. They are the greediest and most annoying company that I have ever dealt with. If they don't have my payment on the 1st day of the month,I recieve phone calls from thier dumb automated machine that wants me to hold. I'm sorry, but I don't hold for phone calls I recieve. Christ the payment isn't even late till after the 15th. Why annoy your customers? Maybe I'll call them and put them on hold and see how they like holding! Maybe if we all do that they will get the message!

Yes!Count me in on the Class Action Suit!

Donna,
I live in Texas too. You can contact me thru this site.... Post your comments below.

I have a suggestion about the phone calls.... Call Ocwen and change your phone number... I did and I NEVER get calls any more... I have it with them as 999 999-9999 same for work... If they won't change it to that in the computer, then make up a number.. If you are paying on time (before the 15th) it shouldn't matter. Now, I do know for a fact that all mortgage payments are due on the 1st of each month. However, most all mortgage companies (except ocwen) have the 15 day grace period before a late charge is assessed. Granted, I know this is not Ocwen's practice.

On the arrearage issue, I too have an arrearage for the same reasons you do... But my arrearage is considered interest, but it does NOT continue to grow.

Are you paying the contractual amount of your mortgage yet? I am and have been for a couple of yrs. now. My big problem with them is the fact that I am not on the mortgage or the note. I have a general warranty deed showing my interest, however, I am not contractually liable for the note. I can just walk away if I want to, and if they get nasty, I will cause they can't do a darn thing to me....Thank God.

Email me, or whatever you need to do to contact me so we can discuss some things. I don't know how this site handles that, but, I won't give my information on line.

Take care, and change your phone number with Ocwen...!!!***
