Ocwen Federal Bank -- Pending Forclosure? -- Forced Insurance -- We have had it ALL .....
First we would Like to to thank the creators of this website...for both my husband and myself we were beginning to think it was just us.
Metwest sold our mortgage to Ocwen in 6/2001.From the very first we have had the same and worse scenerio than alot of you here have had.
We have had the forced insurance..after providing the multiple faxed and certified mailings of our policy from both us and our insurance agent. In fact it renewed in June of this year and again we have received two requests from Ocwen to furnish proof..again two copies of our policy have been faxed and sent to them.Prior to the loan being sold to Ocwen,we optioned to pay our own insurance with documents in the file of Metwest. However our payment was not reduced therefore creating late payments for us for over a year, these late payments have never been addressed to date.
We are now at the " foreclosure " point. We are small business owners, and as everyone knows we have all suffered with our failing economy. We fell behind 30 days last year, and have been sent letters a day or two after the monthly payment was received,at one point we made two payments in one month ,two letters were sent.Verbaly they have said these are $95.00 a letter. However in writing we have never seen this figure outlined. These letter's which are termed " breach " letters do come on attorney' letterheads and never signed but mailed out of Englewood Colorado.Moss, Codillis, Morris etc.etc.)
Upon researching this law firm in Englewood as with surrounding areas, all phone numbers have been disconnected, but postmarks are from there.??????
In February of this year we sent our usual monthly payment, even though we were 30 days behind,a monthly payment was continually sent and excepted, then in March of this year, with no warning our check was returned to us,this has started the worst nightmare.
Upon contacting Ocwen,we were told that we were in default and therefore we needed to look at our breach letter and send the amount stated in a form of overnight to the Florida address, also now that it was March, our payment for March was to be included, and that we had no grace period anymore,(this being only the 3rd of March).Upon looking at the breach letter we had accumulated a $2618.00 default. Our payment is only $873.00.and we are talking two months owed now.
My husband talked to a " Senior Loan CONSULTANT " ha.with the man telling us that he was employed by Ocwen's team of attornies. We needed to send the $2618.00 now and it would take care of the default. We did this and called this CONSULTANT to be told that we should of called him before mailing it for they would reject it also, due to it not being in a form of cashier's check.
Yes it was returned with a letter of insufficient amount to cure default. Not a word on it being in the form of a cashier's check.Mind you all this has been sent to us in regular mail,no security of our mail being tracked. We had been sending our payments certified to the Orlando address because the L.A address was taking up to 21 days to post.We recieved a letter from Ocwen telling us we were using an "unauthorized" address, and to send our payments to L.A,.For this could cause a default or incurr additional late charges.
By the end of March we were again in contact with this CONSULTANT asking what the hell was going on,his reply was that we now were in foreclosure and that the package had been sent to a law firm in Bellvue Washington. However if he should receive a new dollar amount to be determined in " a day or two" that he could call this law office and stop the packet from being opened and save us upwards of $ 700.00 in additional attorney fees.
Now we are angry and start calling for an appt with an attorney. 12 attorneys later we find one that will see us,the reason...The Law firm in Washington also has a firm in Portland, and to speak with us would be a conflict of interest due to the fact that they have worked with this law firm on matters in the past.So we finally find someone who sits us down in his office, looks at some of our 6 inch file of Ocwen paperwork, explains to us that he could possibly help us,but that he may run into a conflict down the line and need for us to find another lawyer to represent us.Again a possible conflict of interest.
Now we are in April and this lawyer tells us to pay what the may statement says which is $4020.00.this includes the months Feb,March,April and May plus past disputed late charges. We receive the check back, again with the fail to cure default letter attached.
Now we have a forebearance letter faxed to us.5 weeks after promised, which in one paragraph reads, that the signers will pay this, this, and this...over $1100.00 a month for almost a year, another paragraph reads that the signers will waive all rights to a lawsuit againest Ocwen for ANY REASON.and further more if the home is scheduled to be sold, that Ocwen is to NOT be held responsible for the failure to stop such sale.
We refused to sign this and requested an audit of our loan to be done and received by us within 10 days, and made an appointment with # 2 lawyer. We were informed that upon the findings of this lawyer they had charged us late fee's on TAXES held in our escrow account as well as the figure of $95.00 a breach letter and a late charge on top of all this. Now in just a couple weeks we owed over $8000.00.To find out what the foreclosure attornies were charging we needed to contact them.
We received the audit which can not be easily read by a layman,as well as one from Metwest.Metwest had told us when contacted that they had sold @ 80% of their residential loans to Ocwen, and that they had received numorus phone calls complaining on the transactions of this company Ocwen Federal Bank. When Metwest looked up our account, they told us that we were in foreclosure. This is in May.
We called one of our senator's and was directed to the department in the State of Oregon in Salem who handles mortgages, complaints and compliances, however we were told that they did not regulate Ocwen Federal Bank, for that Ocwen does not advertise nor write mortgages in our state, they only " service " loans, making Ocwen excempt from bring licensed in the State Of Oregon, and that all the required critieria had been met on behalf of Ocwen to furnish a complaint department as well as a list of other departments to resolve disputes. We do not know about other states, but they are not licensed in our state of Oregon.
Upon finding a well respected lawyer by referal who happens to be a foreclosure lawyer himself,he asked for our paperwork, which we provided and again in a day or two we were told that this had become a serious problem, however to pay the amount requested and to sue for the overcharges in the future when they could be addressed and figured out.
The final figure as of May 31,2002 according to our loan CONSULTANT was now $6087.00 roughly, this included over $900.00 in " FUTURE LEGAL FEES". We decided to wait and receive our foreclosure papers to get an actual final figure to pay.We have been putting our monthly payments aside to try and keep up.
On June 28th,2002, mailed July 2,2002 a letter was sent out by this same loan Consultant saying that Ocwen had attempted numorous times to contact us on behalf of our seriously deliquent loan status, and to no avail had we complied and contacted them over this issue.Upon receiving this we needed to contact him immedietly and work out a plan as to not incur any future legal fees.
NOW TO END..IT IS JULY 7,2002 AND AS WE SIT HERE AND WAIT FOR THESE FORECLOSURE PAPERS TO BE SERVED ... THEY HAVE NOT.!!!!! WE HAVE SEEN OR HEARD NOT ONE THING IN WRITING THAT WE ARE IN FORECLOSURE,AND IT IS NOW 6 MONTHS BEHIND...
Our questions, I guess, are why is this happening to so many of us?, as well as why is no-one who SHOULD be watching for this type of corruption is..Is someone turning the other cheek? .There is so much hurt in our country already that people like us who have had the oppertunity to afford the american dream.have it taken from us so seemingly easy as well as illegally. We have owned our home for over 8 years!!
We are wanting to be on and in the middle of anyone's class action suit as well as we have all documents to prove our case. We do not want to lose our home and will fight to the very end, and not let Ocwen profit at all on the way they have done business in the past as well as in the future!!

Here it is November 8,and as of this A.M our home was sold through auction on the steps of the County Courthouse. However as par usual no-one came to bid.So it is now for sale through a real estate agent in our area.
#1 reason it may have not sold to the highest bidder would be the "posting" of it was in a little paper {circulation 1659 }and 67 miles away from our home.
We have been very active, hiring of the 7 lawyers who did basically nothing,We have our affidavit filed in Hartford and have been in touch with Mr. Hanson on a regular basis. We contacted a U.S Senator in our state who has done wonders and got the O.T.S on board who we have also had constant communication with. But with the CONSTANT filing of papers and research, not to mention the embarrassment and STRESS of losing our home of nine years,it has now come to the "Occupancy Termination Agreement".This is to receieve a payment from this horrible company in turn you agree to the terms set by them.As alot of you have noticed..in your forebearance agreement is has you waving your rights to sue for anything. We never signed this for who the hell has the right to even ask you to wave your rights?..let alone while they are equity stripping our homes.
With this agreement we also received a w-9 to fill out for taxes.
Oh yes we will gladly pay for them to take our home at our loss and pay the government for the difference..NOT !!!
The fight is still on from us,and we have had alot of heat on them from different directions, please do file a congressional inquiry through your state senator.. via O.T.S. We have had a good response from them and although they couldn't "save" our home, they are aware of just what is going on. Also keep those affidavit going to Mr. Hanson for we all need to stay together in this.

Just a short note...considering
The following day after filing our original report we were served { finally } with our trustee' notice of sale. Finally meaning that we have waited for an actual amount to be paid...and you guessed it...no figures for the reinstatement that is our right to bare..Now we are on attornet # 4 and as of this day we have yet to have a response from the " attorney's" in Washington state who are the peons for Ocwen's dirty deeds, furthermore in all of our paperwork..Ocwen is not mentioned as the trustee...The original mortgage company Metwest is, who sold this loan to Ocwen in 2001.We have the documentation to back this up.And to further our confusion..it is said that The Bank Of New York certificate #1999-d is the holder of our note.....who the hell are all these people.
We are waiting...so let you know the updates...our future class action attorney's are also waiting for the hearing in mid August......Cathie.....Yoncalla

Ocwen Federal Bank FSB OCWEN CLASS ACTION LAWSUIT FILED! Ocwen Bank Ripoff includes racketeering, breach of contract, unfair debt collection practices, overcharging borrowers bogus service, Orlando Florida, Nationwide
#4Author of original report
Mon, July 08, 2002
For several months, Rip-offReport.com has been trying to locate lawyers to take on Ocwen Bank. Ocwen bank has retaliated by a series of dirty tricks which include, but are not limited to, filing bogus Rip-off Reports by attorneys or Ocwen employees pretending to be gathering names for a class action suit, when really they were trying to find out who the victims were on the RipOff Report. (no information was ever revealed) They also filed several false claims by individuals posing as victims, who said they had a lawyer in order to collect names off the Rip-off Report.
Rip-off Report has finally located the real McCoy, the actual attorneys pursuing a class action lawsuit against Ocwen, and Rip-off Report has verified the information over the last few weeks.
ALERT---
"Ocwen Federal Bank has been sued for millions of dollars in a Connecticut federal court for racketeering, breach of contract, unfair debt collection practices, overcharging borrowers bogus service and late and escrow fees, harassment, and mail fraud. A court hearing is set for July 18th in Hartford on the plaintiffs' preliminary injunction request."
To all the many victims of OCWEN Federal Bank, Listen up!
A lawsuit against OCWEN has been filed in Connecticut. The lawsuit seeks to become a class action, which would then involve all of you who have been complaining day and night about the mistreatment suffered for months or years at OCWEN's hands. There have always been power in numbers, and the class action lawsuit is now hitting back at OCWEN on behalf of all the honest homeowners that it has trampled on for some time now. If you would like to be included in the class action lawsuit, keep reading.
THESE ATTORNEYS ARE SUING OCWEN FOR ALL THE BROKEN CONTRACTS, FALSE CREDIT REPORTS, HORRIBLE COLLECTION TACTICS, AND EVERY OTHER FRAUDULENT ACTIVITY IT HAS ENGAGED IN OVER THE PAST FEW YEARS. The Court has set a hearing for July 18th on whether to stop OCWEN's abuse.
WHERE TO SEND YOUR INFORMATION:
Submit a notarized sworn statement (or Affidavit) summarizing your experience (much like many of you have already done here at RipoffReport.com, but pay attention to spelling and grammar, please, as this may go into the court record for all to see for ever) If you need help putting this together, send an e-mail to: leagltek@mindspring.com (Kweku Hanson, a victim and is also a lawyer.)
YOU SHOULD ALSO FILE A RIP-OFF REPORT:
Filing a Rip-off Report is also important and should be your first step. Your report will be looked at by other consumers interested with your situation and may relate to and benefit by the rip-off you experienced. The more Rip-off Reports on Ocwen, the more educated other consumers will become, when dealing with Ocwen. This will also help create a better working history on OCWEN and give us the information needed to contact you regarding the disposition of the lawsuit.
TOGETHER, WE CAN MAKE A DIFFERENCE AND STOP THE BIG, BAD WOLF FROM BLOWING YOUR HOMES DOWN, ONE BY ONE.
The lawsuit is seeking over 99 million dollars from Ocwen for all the victims of these rip-offs. By the way, Ocwen has also ripped off folks in England. A consumer group there, called National Association of Mortgage Victims has sued Ocwen in a class action. CLASS ACTION LAWSUITS DO WORK!
The person you will be contaced by is one of the named victims in the lawsuit who is also a lawyer and will be willing to communicate with you. He is not from the law firm handling the actual case, but Rip-off Report is working with Kweku Hanson to locate victims of the Ocwen Bank Rip-off. The informaton will then be forwarded to the law firm which will be handling the case.
The lawsuit is Hanson v. Ocwen, a 100-page class-action complaint filed June 5th in the Federal District Court in Connecticut [Docket #3:02CV960]. The lawsuit seeks punitive damages in the amount of $150,000,000.00.
UPDATE: They are now amending their complaint to ask for $50 BILLION (versus $100 million, as they now feel that this may not---as a ceiling/cap---adequately compensate all the Ocwen's victims.
The lawsuit is being handled Paul Ngobeni, Esq., of Ngobeni & Associates, ..please do not inuneate the attorneys with phone calls. Please wait until you hear from them. Again, file a Rip-off Report, then e-mail the Rip-off Report web address with your contact information to: leagltek@mindspring.com (Kweku Hanson) and he will contact you.
ALSO....
In addition to all the hundreds of complaints we have received on Ocwen Bank in the form of Rip-off Reports, we also receive hundreds of e-mails every week asking for our help.
We have contacted Ocwen on many occasions to arrange a wholesale settlement and they have promised us numerous times that they would settle but they have reneged. They have also had their attorneys threaten us.
Having said that, Ocwen Bank has also tried to post to each and every complaint with the following bogus and useless message:
-----------------------
"If you have a concern regarding the servicing of your loan,
E-mail Address: Customerrelations@ocwen.com
Toll Free Phone #: 1-800-804-5561
Mailing Address: Ocwen Federal Bank FSB,
Attention: Research Department, 12650
Ingenuity Drive, Orlando, FL 32826
We strive to provide each of our customers with the utmost in customer care and professionalism and are eager to address any issue or concern that you feel has not been appropriately addressed."
---------------------
At Rip-off Report, it is our opinion and the opinion of other victims that, Ocwen has no intention of resolving these matters. Victims identify no answer on that phone line for several minutes and in some cases almost an hour. Additionally, other victims post that they have received no response to their correspondence even after Rip-off Report posted their comments.
We have notified Ocwen that we cannot and as a matter of policy, will not post these bogus memos at great expense to our time and resources that are only a ruse and an additional run-around to the victims that come to the Rip-off Report.
