We received a letter a few months ago from the bank's lawyers, MOSS, CODILIS STAWIARSKI ET AL, saying that I hadn't made my house payment. We send our payments to a P.O. box in Los Angeles. They did received the payment and put it through the following month - then we received another letter saying that we had until the following month to make up the default - there was never a default. However, they did charge me a late fee.

Recently, we received another letter from their attorneys saying that we owed $6,572.74 by January 6 - no reason stated. They also stated that I didn't have house insurance - I have mailed a copy of my insurance policy SEVEN times - they recently put a policy on my loan for $2,600. Yesterday, I sent copies of the policy to both the law firm and the bank UPS overnight mail - I did track it and they have received it. I also included my business card and asked them to please give me a call - they have not called.

WE are not behind in our payments - have never been behind. It is effecting our credit report and is very serious. Please advise.

They did the exact same thing to us! Charged bogus late fees, Tried to charge us $2995 for $200 worth of insurance (they didn't succeed on than one), BS legal fees, illegal/false reporting to the credit bureau. We had no choice but to pay over $14,000 just to get rid of them. If we hadn't, there's no doubt in my mind that we would have, in time lost everything! And the worst part of the story is that: there's no guarantee that they won't be back. We have joined one of the Class Action Law Suits to stop them for good. Suggest you do the same or take other available legal action. The people/agencies that are tasked to protect us from these thieves appear to be asleep or just don't give a d**n. They just assume we all are dead beats... after all, why else would we be stuck with such a horrible loan non-servicer!
