A few years ago in December, I was tight on money as a single mom, and had made arrangments to make 2 payments to Ocwen in mid-January. I took the cash to Western Union and put the city code as instructed. However a couple of weeks following, Western Union contacted me that my payment had been returned by Ocwen!

Because of that, I was then technically 3 payments behind and Ocwen initiated foreclosure proceedings on me. They would not take my payments. Now there were foreclosure fees and attorney fees and they wanted this entire huge amount.

I went to court and represented myself (with the help of a legal services membership). Long story short, I proved my case, and the judge ruled that they must accept my payments (I had tucked them away) by now it was about 6 payments; and that they could not foreclose, nor could they charge interest, late payments, attorney fees, filing fees, or foreclosure fees. I am really glad that he very clearly specified that in his orders, along with a time frame that they would be required to accept the payments.

Next I drove up to the attorneys in Denver at the appointed time as the judge has instructed with the back payments, which they had refused to accept up to this point. The managing partner of the law firm came out and gave me a piece of legal paper and she said that I had to sign or they would not receive my payment (this is the Denver attorney firm that Oswen uses nationswide, Modiss & somebody). I had already give them money to the receptionist and was waiting for my receipt (very important document). The paper said that just because I was paying this money, that it didn't cure the "loan default" and that I still owed about $5000 in legal fees, foreclosure fees, filing fees, interest, penalities, etc. I told her I would like a copy of it for my attorney to review (prepaid legal attorney). She said no, that won't be necessary, I see the receptionist has already given you your receipt, never mind. I tired to get a copy of the paper later, to no avail of course! I wanted to show it to the judge, but they knew better than to give me a copy of that paper.

Shocking and shaking, I called the judges office from the cell phone in my car, to let them know that these Denver Attorneys hired by Ocwen were knowingly and deliberatly defying the judges orders. I also filed something in court that they were doing this. Furthermore, after that Ocwen kept on reporting me 6 months delinquent as well as they reported that I was $5000 in arrears due to attorneys fees and I could not refinance. I kept tyring to get them to take it off but they would not; said that I was technically behind and that they had a "right" to report it that way!

I wanted to refinance and get away from these crooks, but they were holding me hostage with this really bad credit rating along with the delinquency of the $5000 in "foreclosure fees."

Finally, in January of the following year, they filed another foreclosure law suit on me for not paying the previous "foreclosure fees" that the judge had ordered them not to charge.

The whole thing was a shocking unbeleivable amazing nightmare. Finally I got an attorney to have them correct my credit rating and take the $5000 off. This whole thing cost me an inordinate amount of time, and money, as well as emotional suffering, thinking they were going to take my house at any moment for about a time period of 2 years!
