Complaint Review: Ocwen Loan Servicing

My husband and I received a devastating certified mail copy from Ocwen on March 31 stating that one of our previous payments was returned by Chase Bank. This notification did not indicate the date of the insufficient payment, nor the amount of the check. A second piece of mail, also received on that day, indicated in a very threatening manner that our mortgage loan is now in default because the March payment was also due.

When I contacted Ocwen on this day, I first spoke with a customer service representative who was obviously not qualified to address this issue and, therefore, offered no pleasant resolution. So, I asked to speak with a supervisor. His name was Sharif. He informed me that Ocwen had received an insufficient funds notice from Chase Bank dated March 1, 2007. When I asked which payment this letter was referring to, I was told that it was regarding a payment made July 31, 2006. I immediately inquired as to how Chase waited just shy of a year later to release this information to Ocwen. Sharif then told me that Ocwen had made a mistake and because of that they were prepared to expeditiously help us to rectify the situation.

According to Sharif, in an attempt to correct the error, Ocwen had reversed our March 2007 payment and applied it to the alleged missed payment in July of 2006. I was mortified because this should not have occurred before my husband and I were briefed on the situation. I then expressed concern that now my March payment is considered late and that we were now desperately hoping to prevent this missed payment from being reported to the credit bureaus. Sharif again told me not to worry, Ocwen was willing to work with me, and that he would make sure that there was no negative credit reporting, as Ocwen was committed to resolving this most delicate dilemma.

Well, that was a mistruth. Today, my husband learned after trying to obtain credit that he had been denied due to our mortgage being reported late for March. We were appalled by the inconsistency in the statements made by Sharif and the public embarrassment it has caused. I have spoken to Chase, a bank we are no longer affiliated with, and were told that they forwarded no such letter to Ocwen. Today, I phoned Ocwen and spoke with another supervisor who said that she would do what she could to reverse the negative credit rating and that I should forward my concerns to Ocwen's Research Department.

Additionally, we have sought legal counsel and contacted the local media to explain our plight. We are asking that Ocwen reverse the negative credit reporting, reinstate the March payment, and revert the July payment to a positive status. We have had our fair share of financial woes over the last year, and just as were looking forward to financial stability, we were hit with this economic hardship.
